PUBLIC HEARING
1.An application for Conditional Use permit for a 100 ft. by 60 ft. storage building on property in
the C-2 General Commercial Zone. The subject property is located at 4526 and 4528 Burley
Drive, Chubbuck, ID. Type of Action: Public hearing and Land Use decision.
Stewart Ward, Dioptra, 4880 Clover Dell, representing the applicant. Ward stated request would be the
second storage building on property and will be the exact same size, look and feel as existing building.
Other building was approved in March and built earlier in the year. Two homes adjacent to the site
were purchased by the property owner and were leveled and property is now a clear gravel lot.
Applicant still wants to put building further back from the road for additional buffer space. Utilities
needed are all already onsite. Requesting second conditional use permit.
Mendenhall asked if existing storm retention pond is large enough to handle second storage building.
Ward stated the pond was designed to collect all the water on site and pond will not be impacted at all.
Paul Andrus, Planner, gave staff report. Andrus indicated conditional use permit for storage unit is
allowed in a C2 designation.
Mendenhall opened the public hearing.
Brandon Jackson, 1042 Lexington, applicant, testified in favor. Jackson stated they don’t have an
immediate use for the area in the front of the property but plan to go to city in December for a short
plat to include the section in their campus as one parcel. Jackson stated they have already filled the first
building and it’s almost overflowing. Have kept traffic to minimum since the purchase of the two lots
and has become a nice asset to the campus.
Nikki Taysom, general delivery Pocatello, ID 8301, no physical address, testified neutral to the
application. Taysom asked what will be stored in second building, what plans are for future
development, and if both items meet the standards for the city.
Mendenhall closed the public hearing brining the meeting back to the commission.
Mendenhall, asked if property will have basic landscaping or will be left as is. Jackson, Applicant, stated
they will keep gravel for now and will do regular weed maintenance. They have added a buffer of trees
along the railroad side and will also add a buffer of trees along Burley side as required by city code.
Right now lot is fully fenced. In response to Taysom’s question, Jackson stated they plan to store
marketing items for example, right now they have 7,500 basketballs they have donated to YMCAs across
Idaho. They do not store chemicals anywhere on site other than minor household items and diesel fuel
for generators.
Mendenhall entertained a motion. Smith moved to approve application for conditional use permit.
Schwartz, seconded.
With all commission members understanding the motion they voted.
Roll Call Vote: Budge, Yes; Berls, Yes; Holm, Yes; Smith, Yes; Schwartz, Yes; Stoddard, Yes;
Mendenhall, Yes. Motion carried.
GENERAL BUSINESS
1.Study Session on liabilities, assets and land use policies.
Public Works Director, Rodney Burch, and Planning and Development Director Devin Hillam, presented a
study (Exhibit 1) they had been working on to benefit the City’s future land growth and financial
resiliency. Burch stated that growth patterns and land use policies play a critical role in the City’s
financial sustainability. Hillam stated that new growth on the fringe of the City will always be desired,
however incremental growth within the current City limits has a greater benefit to the financial
resiliency of the City. Burch gave examples of valuations per acre for single family residential,
multifamily, PUD, and commercial developments. 33% of the current city limits (not including the recent
undeveloped annexations) is underutilized or vacant property. Infill/incremental growth increases
utilization of land without increasing infrastructure/service costs; which in turn has the potential for
lower utility rates, lower tax rates, and a decrease in future liabilities. Burch gave examples of the costs
that growth has on infrastructure, and the impacts to EMS, Fire, and Police services.
Hillam gave an example of the Country Acres subdivision that was built in the 70s. Since its development
it has brought in $3.2 million in tax contributions, of those tax contributions $625,000 was allocated to
highway, streets, and roads. In 2018, the City of Chubbuck and Chubbuck Development Authority spent
$4.4 million to reconstruct the streets in that area.
Burch and Hillam presented potential ideas moving forward to focus on incremental growth and
financial resiliency for the City. These ideas included increased quality at initial construction, increase
preventative maintenance to extend life of roadway/infrastructure, decrease the amount of
roadway/infrastructure required by development to reduce future liability, better promote
infill/incremental growth, and review standards and processes that impact valuations and fiscal liabilities
to the City.
Mendenhall was concerned that the cost of housing would go up and cautious that through changes
that benefit city, they don’t inadvertently cause the single family homes housing costs to increase
dramatically. Burch stated that the 33% is a resource that lends itself to more affordable housing than
growing on the outskirts.
Stoddard and Smith expressed concerns about resistance that may come from established community. A
lot of neighborhoods are resistant to higher density developments especially when it’s in their
backyards. Hillam stated the new proposed PUD ordinance addresses how to do infill carefully and how
it applies to those existing neighborhoods. Education is key and cultural change is needed.
Jackson commented on the aspects of economic impact of market and marketing the community and
stated city wouldn’t want to go so far that Chubbuck is full of high density housing and full of starter
communities. Hillam agreed and stated there is a balance that needs to be met.
Budge stated whatever policies are created, they need to be done in a way that it adds value and makes
the community more attractive. Hillam stated that he believed that the PUD ordinance as drafted by
staff will address those concerns raised.
Mendenhall wished everyone a happy Thanksgiving and safe travels.
Mendenhall entertained a motion to adjourn; Berls made the motion. Schwartz seconded. All voted to
adjourn at 8:18pm.

Re: Proposal to amend the zoning map to change zoning of land from Limited Residential (R-2) to
General Commercial (C-2) on approximately 0.4 acres of land recently acquired by the City and
Chubbuck Development Authority as part of the City Hall/Downtown process.
SUMMARY SHEET
BACKGROUND: In 2018, the City identified the area surrounding the subject property as the location of
the future urban core and of the new City Hall building. A location was selected for City Hall and it was
acquired by a second party until such time that the City had the means and need to acquire it. As the site
plan process progressed for City Hall, it was realized that the project would not need to consume the
entire portion of the property and that the remainder could be developed into additional pad sites to
kickstart the downtown inertia. The subject property was identified as key in the location of a potential
pad as well as a major route to the new City Hall and said pad sites, in addition to surrounding properties
in the downtown area. On behalf of the City and Chubbuck Development Authority, I respectfully submit
this application packet.

ANALYSIS OF CRITERIA TO EVALUATE CHANGE IN LAND USE DISTRICT:
1: How does the proposal affect the delivery of services by any political subdivision providing
public services to the property, including the school district? — Idaho Code 67-6511(2a)
Among political subdivisions serving the property, are the City of Chubbuck, Bannock County,
Portneuf District Library, and State of Idaho. The change in zoning from R-2 to C-2 should not
affect any of said entities negatively but will allow for an increased land use intensity within the
downtown area, a fact which should, once a portion of the subject property is divested of the by
the Chubbuck Development Authority, create higher tax revenues which existed prior to the
acquisition by a public agency. The existing dwelling was constructed in 1935.
2: Does the proposal conflict with the conflict with the policies of the Comprehensive Plan? -
Idaho Code 67-6511(2c) & City Code 18.28.050
This property is designed on the Comprehensive Plan Future Land Use Map as being for
Employment"; the corresponding zoning districts for the "Employment" designation being C-2 or
Industrial, per Table 4-3 of the Comprehensive Plan. As such, this request brings the property's
zoning into alignment with the Plan.
The petition for a rezone of the property is supported by the numerous Plan policies, as are

18.08.030: GENERAL CONTROLS BY DISTRICT: 0
A. The general controls for each district set forth by this title shall be the minimum regulations
and shall apply uniformly to each class or kind of structure or land, except as hereinafter
provided:
1. No structure or land shall be used or occupied and no structure or part thereof shall be erected,
constructed, reconstructed, moved or structurally altered except in conformity with all of the
regulations herein specified for the district in which it is located and in conformity with all other
applicable laws, codes or regulations.
2. No building or other structure shall be erected or altered to:
a. Provide for greater height or bulk;
b. Accommodate or house a greater number of families;
c. Occupy a greater percentage of lot area;
d. Have narrower or smaller rear yards, front yards, side yards or other open spaces, other than as
herein provided, or any other manner be contrary to the provisions of this title.
3. No side yards in a lot within A, R-1 or R-2 Districts, which are improved by an inhabitable
structure at the time of passage of this title, shall be reduced in width below five feet (5). Areas
and dimensions of all other lots and yards shall meet at least the minimum requirements set
forth herein.
B. General controls by district shall be as set forth in the schedule below. Specific uses are
permitted where indicated in the schedules by the letter "P"; provided, however, that the City
building official or the Design Review Committee may, in accordance with the procedures
set forth in subsection C of this section, require the issuance of a conditional use permit
prior to allowing such use. Where the letter "C" appears, it denotes a use allowed in the
district in question only upon issuance of a conditional use permit as herein provided. An "X"
indicates that the use is neither allowed nor conditionally permitted. Any proposed use which
is not specifically mentioned in the schedule below, is neither allowed nor conditionally
permitted in residential land use districts, but is permitted in all other land use districts
unless the City building official or Design Review Committee determine, in accordance with
the procedures set forth in subsection C of this section, that such use should only be
allowed upon the issuance of a conditional use permit.
C. The City building official in reviewing an application for a building permit, and the Design
Review Committee, in reviewing an application for design review clearance, may determine
that a particular land use, although designated in the schedule of general controls as a
permitted use, should be allowed only upon the issuance of a conditional use permit. In
making this determination, the City building official and Design Review Committee shall rely
upon the criteria and standards set forth in subsection 18.28.040C of this title. If a
conditional use permit is required, the applicant shall immediately thereafter be notified of
224 E Linden
Attachment 2
this determination and shall be advised of the procedures governing the Land Use and
Development Commission's consideration of an application for a conditional use permit.
D. When several combined land uses exist or are proposed, the most intensive land use shall
be considered the primary activity or use for a planned unit development as set forth
in chapter 18.20 of this title. All nonprimary activities or uses outside a planned unit
development shall only be allowed in accordance with the schedule of general controls,
unless the same constitutes subordinate uses which are customarily incidental to and
located on the same lot or in the same building as the primary activity or use.
E. Any reference in the schedule of general controls to a use as conditionally permitted does not
constitute a finding or declaration by the City Council that such use would necessarily be
consistent with the comprehensive plan of the City. The Land Use and Development
Commission and City Council shall not approve an application for a conditional use permit
for a particular proposed use unless such proposed use is found to be consistent with the
comprehensive plan and conforms to the criteria set forth in section 18.28.050 of this title.

STANDARDS FOR REVIEWING A CONDITIONAL USE PERMIT
The following code regarding CUPs should be used in evaluating and weighing the application:
18.28.040 C. Criteria and Standards:
C. Criteria And Standards: The following criteria and standards shall be applied in determining whether
to grant or deny any application under the terms of this title for a conditional use permit, and in
considering and defining the conditions (if any) to be imposed upon a conditional use permit
granted hereunder:
1.The use for which such permit is sought must not be injurious to the neighborhood or otherwise
detrimental to the public health, safety or welfare.
Staff Analysis:
Staff finds that as presented there is likely no evidence that the use for which the permit is
sought would be injurious to the neighborhood nor public health, safety or welfare. The
applicant indicates that there will be little noise, odors and waste from the proposed use.
Several other allowed uses could be more intrusive such as amusement center, newspaper,
equipment rental and sales yard, industrial equipment and sales, furniture and cabinet shop,
etc. An unoccupied building has a tendency to be neglected and not maintained especially as
a former big box store that tend to be difficult to fill given current national trends.
2.The permit sought shall not produce an adverse impact on the economic values of adjacent
properties.
Staff Analysis:
Staff is not aware of any negative economic impact to adjacent properties caused by the
proposed use. An occupied building being kept up, is likely more positive on the neighboring
buildings than a dark/vacant store.
PO Box 5604 – 5160 Yellowstone Avenue, Chubbuck, ID 83202
208.237.2430 – Fax 208.237.2409
www.CityofChubbuck.us
3.The permit sought shall not produce a negative impact on transportation facilities, public
utilities, schools, public parks or the natural environment any greater than had the strict terms
of this title been satisfied.
Staff Analysis:
The evidence suggests that the negative impact on transportation facilities, public utilities,
schools, public parks or the natural environment would be no greater than if the strict terms
were satisfied. The historical retail use would tend to generate more tips per day than the
proposed use.
4.Account shall be taken of noise and traffic conditions in the vicinity of the land for which the
permit is sought.
Staff Analysis:
Staff finds that the evidence would suggest that the trips per day would be less thus reducing
the impact of noise and traffic.
5.Account shall be taken of the character and use of the buildings and land adjoining and in the
vicinity of the property for which the permit is sought, together with the number of persons
residing or working in such buildings or upon said land; and the permit, if granted, shall not
work an unreasonable hardship upon surrounding property owners by virtue of its physical
nature or by the impact of changes made in the landscape of said land.
Staff Analysis:
The building will not be changed on the exterior thus limiting the hardship on surrounding
property owners. The applicant has represented that noises, odors, and waste from the
operations will be minimal and thus there should be nothing which would affect adjoin land
owners.
6.Account shall be taken of the aesthetic qualities of the proposed use and surrounding lands.
Staff Analysis:
Staff finds no evidence to suggest aesthetic change in the property or buildings since no
changes to the site are proposed.
7.Account shall be taken of the support or opposition expressed by persons entitled to receive
notice of the conditional use permit application.
Staff Analysis:
No Comment has been received by staff on this project as of this writing.
8.The applicant shall show that he has taken all reasonable steps to comply with the strict terms
of this title. If the applicant can show that the uses "allowed" under this title are not feasible,
such showing shall support an application for a conditional use permit.
Staff Analysis:
Light manufacturing and laboratory Research is conditionally permitted in a C-2 General
commercial zone.
9.Adverse impact on other development within the city shall be minimized as far as possible.
Staff Analysis:
Staff finds that there is likely no evidence of impact on other development in the city.
PO Box 5604 – 5160 Yellowstone Avenue, Chubbuck, ID 83202
208.237.2430 – Fax 208.237.2409

10.The sequence and timing of any development conditionally permitted hereunder may be
controlled as appropriate.
Staff Analysis:
Staff finds there is likely no need to control the sequence and timing of the project.
11.The duration of any development conditionally permitted hereunder may be controlled.
Staff Analysis:
Staff finds that since this is an existing permanent building there would be no reason to control
the duration of the development.
12.Any permit granted hereunder may contain provisions for assuring that the development is
maintained properly.
Staff Analysis:
As this is next to the Pine Ridge Mall and other businesses the owner has a vested interest in
its appearance and maintenance.
13.Any permit granted hereunder may designate the exact location and nature of the permitted
development.
Staff Analysis:
The applicant will be required to meet building codes for interior remodel, no exterior changes
to the existing building therefore exact location and nature of development would likely not be
necessary.
14.Any permit granted hereunder may require the provisions for on site or off site public facilities
or service.
Staff Analysis:
Staff does not find that any additional public facilities or service are likely needed.
15.Any permit granted hereunder may require more restrictive standards than those otherwise
required by this title.
Staff Analysis:
Staff would recommend a condition that if the use turns out to be different (more Intense) than
what is presented in the application that it will be revisited by the commission.
The Commission should evaluate criteria and public comment to determine if more restrictive
standards are needed.
16.Notwithstanding the time deadlines established elsewhere in this title for processing
applications, the city council may, if it deems such action necessary, require studies of the social,
economic, fiscal and environmental effects of the proposed conditional use prior to the
granting or denying of the application therefor, and the applicable time deadline shall be
extended accordingly. (Ord. 320 § 1, 1989: Ord. 246 § 2, 1983: Ord. 241 § 7-4, 1983)
Staff Analysis:
Staff does not find likely cause for additional studies to be required.
18.28.050: CONSISTENCY WITH COMPREHENSIVE PLAN:
No variance shall be granted, nor any conditional use permit issued, nor any revision to this title adopted,
unless such action is consistent with the city's comprehensive plan.

The Shopko building has been vacant for the past eight months. This applicant will return the property to productivity,
bringing jobs and vitality to the area and avoiding the blight that commonly occurs with vacant commercial properties.
This applicant's employees and customers will positively impact surrounding businesses.
Productive use of the property will generate revenue to support transportation facilities, public utilities, public parks and
the natural environment. The proposed use of the property will not create adverse impacts. Refuse will consist of used
pallets, cardboard, and recyclable metals and plastics. No toxic materials are used in the process and there will be no refuse
requiring special handling.
The proposed use will not generate noise pollution. The property is an area designed for commercial traffic. Traffic
is expected to be less intense than occurred when Shopko occupied the property. With 823 parking spaces there is more
than enough space to accommodate applicant's business.
This proposal does not seek to change the character of the property or the land in the vicinity of the property. There are
no residences within 300 feet of the property. The property will be used for research and development, light manufacturing,
assembly, and retail purposes. There will be no business activities on the exterior of the building except for employee and
customer parking and delivery vehicles. The business will not generate noise, odors, or visual impacts outside the building.
This development is entirely compatible with surrounding property uses (Pine Ridge Mall, Gem Prep Academy, Allstate
Insurance, Home Depot, and AMC Theater).
5. Explain how the permit, if granted, will not work an unreasonable hardship upon surrounding property
owners by virtue of its physical nature or by the impact of changes made in the landscape or natural scenery
of said land?
6. What considerations have been given to the aesthetic qualities of the proposed use and surrounding lands?
7. Address how adverse impacts on other developments within the City have been minimized as much as
possible.
8. Describe the sequence and timing of the proposed development.
9. How will the development be properly maintained?

Conditional Use Permit Questionnaire
Revised 1-25-2017 PBA
This project will have no adverse impact on surrounding property owners.
This project will improve the aesthetic qualities of the property and surrounding lands via improvements to the facade of the
of the building and active use of the property. Having the property occupied will negate the blight issues that often surround
vacant commercial properties.
There will be no adverse impacts on other developments within the City; rather, renewal of the property will bring employees
and customers which will add value to other developments within the City.
Upon satisfaction of all contingencies and issuance of building permits, improvements will be made to the interior and
exterior of the building, with the goal of opening for business within 90-120 days.
The property will continue to be maintained in good condition and repair as part of the Pine Ridge Mall complex.
10 Designate the exact location and nature of the development.
11. Which on-site or off-site public services are required for this development? (E.g. - Sanitation, Water,
sewer, other.)
12. List which, if any, studies of social, economic, or environmental effect have been required of this
application. (Examples: Traffic Study, Water or Sewer Capacity Study, Storm-Water Drainage, etc.)

SEICAA (SOUTHEASTERN IDAHO COMMUNITY ACTION AGENCY)
APPLICATION FOR ANNEXATION AND ZONING - STAFF REPORT
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING OF JANUARY 14, 2020
SUMMARY
An application for annexation of approximately 17.4 acres of land into the City of Chubbuck and
to include the property in the Limited Residential (R-2) Zone, and to change the zoning on
approximately .2 acres of land from Agriculture (A) to Limited Residential (R-2). The
Comprehensive Plan Future Land Use map designates this area as Mixed Use. Property is in the
NW ¼ of Section 9, Township 6 South, Range 34 East of the Boise Meridian, Idaho. The subject
parcels are generally located on the east side of Philbin Road, north of the Redman Lateral Canal
and south of the future alignment of Sawtooth Street in Chubbuck, Idaho. Type of Action:
Recommendation.
STAFF FINDINGS
After review the application, Staff finds that it likely meets the requirements for annexation into
the City and for designation in the Limited Residential (R-2) Land Use District.
The Comprehensive Plan Future Land Use map designates this area for “Mixed Use”
land uses and development, which is supported by the R-2 zoning district, as well as
other residential zoning districts (R-1, R-3 and R-4) and Limited Commercial (C-1).
The western 25 feet (.2 acres) of the larger SEICAA parcel (Parcel 1) lies under Philbin
Road. It was annexed in 2007 and placed in the Agriculture (A) Land Use District.
The area to be annexed is approximately 17.4 acres.
The parcels are surrounded on all sides by the City limits, and with the owner as
applicant this is a Category A annexation per Idaho Statute 50-222.
The area is within the Urban Service Boundary. Water and sewer services are available in
Philbin Road, and stubbed to the site via Sawtooth Street and Pinewood Avenue to the
east.
With surrounding residential and civic land uses R-2 is an appropriate zoning
designation for the property.

ALPINE CROSSING DIVISION 1A
PRELIMINARY PLAT REQUEST - STAFF REPORT
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON JANUARY 14, 2020
STAFF FINDINGS SUMMARIZED
After reviewing the Alpine Crossing Div. 1A preliminary plat, Staff finds that it appears to meet the code
requirements with the following comments:
Recommendation and approval must be conditional upon annexation of the property and
designation in the appropriate land use district (Limited Residential R-2).
Easements need to be shown for utilities stubbed beyond the subdivision boundary.
The parcels in blocks 3 and 4 include a 35’ right-of-way for the Redman Canal. Because this
area is unbuildable the lots are designed to be deeper than others, which causes lots 3, 4, and
5 of Block 3 to slightly exceed the depth to width ratio for the R-2 zone.
Preliminary Plat recommendations are conditional upon City Council approval of the plat.
FACTS
REQUEST: The applicant proposes a 21 lot Preliminary Plat for 20 single family residential lots and 1 common
lot in the Alpine Crossing subdivision, Division 1A. It includes an extension of Pinewood Avenue west of
Independence Avenue for access to this phase.
BACKGROUND: Prior to acquiring this property, SEICAA received approval for a Division 1 of Alpine Crossing,
located south of the Redman Canal along Alpine Avenue. Because this phase will be the first to be built,
and the name Division 1 has been reserved, this plat will be called Division 1A.
TYPE OF COMMISSION ACTION: Quasi-Judicial (Subject to appeal; decisions must be supported by
the evidence and by applying law to the facts; decisions shall be based on the standards for
approval). Recommendation/approval of this preliminary plat shall be whether it meets the requirements
of the City of Chubbuck ordinance and State of Idaho statutes. The Commission may recommend
approval with or without conditions, may table a decision, or may recommend denial of the
application.

Alpine Crossing Division No. 1A - Preliminary Plat Narrative
1. The subdivision proposal complies with the applicable provisions of this title. The current project as
proposed meets the applicable provisions of this title.
2. The subdivision proposal complies in principle with all applicable City design standards and
development regulations. All lot sizes, rights-of way, roadways, utilities etc. have been designed to
comply with the city standards and development regulations.
3. The subdivision proposal complies with all applicable zoning requirements of the underlying zoning
district, applicable overlays, and other applicable development standards. The current project is
anticipated to be located within a Residential (R-2) zone within the city and will follow all of the
parameters, guidelines and development standards that the (R-2) zone requires.
4. All public facilities including streets, sidewalks, curbs, gutters, water, sewer, fire protection, and
sanitation services can be provided to the newly created lots and accommodate future extension to
adjacent land. The use of a "control strip" intended to control or prevent the future extension of public
facilities or development of adjacent land is prohibited. The current layout of the project allows for the
extension of public facilities to the west along Pinewood Avenue and north and south along Nordic
Drive. There are no areas within this develop that prevent or control access to adjacent lands.
5. If city public works determines that the proposed subdivision will result in significant traffic impacts
then a "traffic impact study" will be required as part of the commission's review. A significant traffic
impact is generally defined as occurring when:
a. A Proposed development or redevelopment of a site will generate 100 or more new peak hour
trips; or
b. The added volume is equal to 1,000 vehicles per day.
The proposed project will only consist of 20 households. Assuming an overall national average of 10
trips per single family household per day (20 x 10 = 200) and 1 peak hour trip per day (20 x 1 = 20), the
200 total trips per day and 20 total peak hour trips per day will not generate enough peak hour trips
or total trips to warrant a traffic impact study.
6. The proposal provides for a continuation of a connected transportation system unless topography or
natural features prevents connection to abutting streets or property. As stated in item #4, the proposed
layout will allow for the extension of public facilities west along Pinewood Avenue and north and
south along Nordic Drive. There are no natural features or topography that will prevent future
connections.
7. The proposed subdivision provides for bicycle and pedestrian transportation routes and amenities in
accordance with Bannock Transportation Planning Organization's adopted bicycle and pedestrian plans.
The proposed subdivision will have sidewalks running throughout that connect into the adjoining
sidewalks within Park Meadows subdivision. Proposed sidewalks will end at future tie in points to
Alpine Crossing 1A
Exhibit 4
future phases to the north, west and south. This will provide adequate transportation routes for both
bicycle and pedestrian traffic to circulate throughout the future neighborhoods.
8. Public utilities are provided to the newly created lots in public rights-of-way or in appropriately sized
easements (Ord. 773, 2018) The proposed project will have new water, sewer, storm and irrigation
utilities provided within the right-of-way. It will also have a 10' public utility easement provided
within the platted subdivision for public utilities i.e. phone, cable, power and gas, to install their
infrastructure to provide services to the new facilities that will be built.

SAWTOOTH RIDGE SUDBIDIVISION
PRELIMINARY PLAT REQUEST - STAFF REPORT
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON JANUARY 14, 2020
STAFF FINDINGS SUMMARIZED
After reviewing the Sawtooth Ridge preliminary plat, Staff finds that it appears to meet the code
requirements with the following comments:
The parcel of the proposed development has agricultural water rights. Per City Code 16.12.230,
“All developments with appurtenant agricultural water rights shall be required to construct a
secondary pressure irrigation system to the standards of this section to utilize the water rights
for the development.” Following this provide facilities to supply adequate pressure and flows
of secondary irrigation which meets standards of the design manual, “City of Chubbuck
Pressure Irrigation Systems”.
The existing 230’ x 25’ access easement along the north line of the development will need to
be vacated in agreement with the easement holder, prior to recording the final plat.
Preliminary Plat recommendations are conditional upon City Council approval.
FACTS
REQUEST: The applicant proposes an 11 lot subdivision with 9 multi-family residential building lots, one
common lot, and one parcel for street dedications in the Sawtooth Ridge subdivision. The streets parcel
will accommodate widening Philbin Road and extending Sawtooth Road east of Philbin for access to the
property.
BACKGROUND: This is a 2.8 acre parcel at the northwest corner of Sawtooth and Philbin. It was recently
changed from the Agriculture (A) Land Use District to Dense Residential (R-4), which complies with the
City Comprehensive Plan. The parcel is currently being farmed. It was annexed to the City in 2006.

GOAL 4.5 ENCOURAGE COMPATIBLE LAND USES
OBJECTIVE 4.5.1 Encourage a transition from low-intensity to higher intensity land uses
POLICY a. Adhere to land use designations on the Comprehensive Plan Map
COMMENT The map designates the area as “Employment”, a category intended for future C-2 and I zoning.
However, the subdivision complies with the Northside Crossing Master Development Plan
(MDP), which includes commercial and industrial uses. The intent of the Creative Community zone
is to go in any 5 acre site or larger throughout the city.
POLICY b. Use a combination of zoning, performance requirements, site planning, and transportation
routes to create the highest level of compatibility between adjacent uses while retaining a
complementary mix of possible uses within neighborhoods and communities
COMMENT As part of Northside Crossing Creative Community the project contributes to all of these points.
OBJECTIVE 4.5.2 Encourage a mix of compatible uses in new neighborhoods and in redevelopment areas
POLICY a. Use design standards to encourage compatibility of mixed use development with surrounding

access management guidelines
COMMENT The project appears to conform to this objective.
OBJECTIVE 5.1.2 Expand the network of functional class roads in general accordance with the functional
class roads map
POLICY a. Define routes for new or functional class roads with requirements for development during
subdivision
COMMENT The project includes extensions of collectors per the Northside Crossing MDP.
OBJECTIVE 5.1.4 Encourage higher densities and site designs that support transit
POLICY a. Phase public service extensions over time to protect prime agricultural land and increase

Exhibit 3
Northside Crossing Division No. 3 - Preliminary Plat Narrative
1. The subdivision proposal complies with the applicable provisions of this title. The current project as
proposed meets the applicable provisions of this title.
2. The subdivision proposal complies in principle with all applicable City design standards and
development regulations. All lot sizes, rights-of way, roadways, utilities etc. have been designed to
comply with the city standards and development regulations set forth within the creative community
zone.
3. The subdivision proposal complies with all applicable zoning requirements of the underlying zoning
district, applicable overlays, and other applicable development standards. The current project is located
within an approved Creative Community (CC) zone within the city and will follow all of the
parameters, guidelines and development standards that the (CC) zone requires.
The current layout of the project allows for the
extension of public facilities to the north along Northside Crossing as well as west along Journey Way
and again north along Radiance Court. There are no areas within this develop that prevent or control
access to adjacent lands.
The proposed project will consist of 28 residential with 1 open space lot. Assuming an overall national
average of 10 trips per single family household per day (28 x 10 = 280) and 1 peak hour trip per day
(28 x 1 = 28), the 280 total trips per day and 28 total peak hour trips per day will not generate enough
peak hour trips or total trips to warrant a traffic impact study.
6. The proposal provides for a continuation of a connected transportation system unless topography or
natural features prevents connection to abutting streets or property. As stated in item #4, the proposed
layout will allow for the extension of public facilities north along Northside Crossing as well as west
along Journey Way and again north along Radiance Court. There are no natural features or
topography that will prevent future connections.
7. The proposed subdivision provides for bicycle and pedestrian transportation routes and amenities in
accordance with Bannock Transportation Planning Organization's adopted bicycle and pedestrian plans.
Northside Crossing 3
Exhibit 4
The proposed subdivision will have sidewalks running throughout as well as a 10' paved trail that will
meander through the open space areas. The sidewalks will provide tie in points to future phases of
the Northside Crossing neighborhoods to the north that will have sidewalks running throughout. The
trail within the open space will also provide tie in points to adjoining opens space areas to the north
and south of this phase. This will provide adequate transportation routes for both bicycle and
pedestrian traffic to circulate throughout the future neighborhoods.
