CITY OF CHUBBUCK, IDAHO
WHERF~S, notice pursuant to Chubbuck City Ordinance No. 143
has been given to L. D. Fitzgerald, Trustee in Bankruptcy for
the United States District Court, who holds trustee's title to
certain lands in the estate of a bankrupt, that a nuisance in
the form of~eeds ex£sts upon said lands; and
WHEREAS, the lands are described as set forth on the
attached list, ~hich is incorporated herein by reference as
though set forthfn full; and
WHEREAS, said L. D. Fitzgerald has not appealed to the
City Council, nor appeared in response to the notice, as provided
in Ordinance NO. 143; and
WHEREAS, C~dinance No. 143 authorizes the City Council by
resolution to direct that the weeds be removed by employees of
the City or by others whom the Mayor shall designate, with the
resultant cost reimbursed to the City by special assessment
against the premises as authorized by Idaho Code sections
50-334 and 50-1008;
NOW, THEP, EFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF C~UBBUCK, IDAHO:
1. That a nuisance in the form of wee~s is found to exist
on the above-described lands, in violation of Ordinance No. 143.
2. That the May~r is directed to arrange for removal of
the weeds by 6ity employees or othe~'whom he may designate.
3. That the City Clerk/Treasurer is directed to levy a
special'assessment against said lands for the resultant costs,
and to certify the assessment to the county tax collector if
the assessment is not paid within thirty (30) days after notice
of the assessment has been furnished to L. D. Fitzgerald, Trustee
in Bankruptcy.
