CITY OF CHUBBUCK, IDAHO
WHEREAS, the Mayor and Council of the City of Chubbuck, following
competitive bidding as provided by the Idaho Code, have accepted bids
from suppliers with respect to a backhoe and with respect to a garbage
packer and truck combination; and
WHEREAS, the Mayor and Council have found that leasing such items
with option to purchase, through a bank, represents best use of the
City's present financial resources; and
WHEREAS, the Idaho Constitution prohibits the City from incurring
any indebtedness or liability beyond one year for an expenditure of
this type;
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE
CITY OF CHUBBUCK:
1. That the lease-purchase of a backhoe is hereby authorized.
2. That the lease-purchase of a garbage packer and truck combination
is hereby authorized.
3. That the terms of the lease-purchase agreement, as to each item
of equipment, shall not create an indebtedness nor establish any liability
on the part of the City for any period greater than one year at any given
time; and that, if the City should discontinue performance under the lease-
purchase agreement, the lessor-seller's remedy shall be limited to retention
of moneys paid and re-possession of the equipment.
4. That this resolution, or a copy thereof, shall be attached to
any lease-purchase agreement and shall constitute an integral part of the
contract between the City and the bank, notwithstanding any statement in
the agreement instrument that it merges the entire agreement of the parties.
