A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO, GIVING NOTICE OF THE CITY COUNCIL'S
INTENTION TO CREATE A LOCAL IMPROVEMENT DISTRICT, TO
MAKE CERTAIN IMPROVEMENTS AND TO LEVY ASSESSMENTS TO PAY
ALL OR A PART THEREOF; DESCRIBING THE BOUNDARIES OF THE
DISTRICT; DESCRIBING THE IMPROVEMENTS CONTEMPLATED
TOGETHER WITH AN ESTIMATION OF THE TOTAL COSTS AND
EXPENSES OF THE SAME; PROVIDING A STATEMENT OF THE TIME
WITHIN WHICH AND THE PLACE AT WHICH PROTESTS SHALL BE
FILED AND OF THE TIME AND PLACE AT WHICH THE COUNCIL
WILL CONDUCT A PUBLIC HEARING TO CONSIDER SUCH PROTESTS.
WHEREAS, it is necessary prior to creation of a Local
Improvement District, for the City Council to adopt a
resolution giving notice of its intention to create a local
improvement district; and:
WHEREAS, the City Council has determined that it is
necessary to create a local improvement district in the area
described hereinafter for the purpose of making certain
improvements along Homestead Road; and
WHEREAS, the City Council wishes to g~ve notice of its
intention to create such a local improvement district;
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Chubbuck:
SECTION 1. Legal Description. The legal description of
the boundaries of the local improvement district to be
created and the property to be assessed, is as follows:
(see Exhibit "A" attached hereto)
This land hereinafter referred to as the Homestead Road Local
Improvement District lies adjacent to and contiguous with
Homestead Road in the City of Chubbuck.
SECTION 2. Description and Cost of Improvements. The
improvements contemplated and the estimated total cost and
expenses of the same are as follows:
1. A sewer line with manholes and service
connections stubbed to the property line,
constructed from manhole P-9 (located approximately
200 feet east of the west end of Homestead Road) to
the east end of Homestead Road, a distance of
approximately 1100 feet. The estimated cost is
$17,000.
2. A water line, complete with fire hydrants, and
service connections, constucted the full length of
Homestead Road extending from Hawthorne Road west a
distance of approximately 1300 feet. The estimated
cost is $17,000.
3. The existing street will be replaced with a
surface equal to the existing street surface. The
estimated cost is $5,000.
4. Engineering and bond counsel costs. The
estimated cost is $5,500.
All of the costs of Items 1, 3 and 4 will be paid from a levy
of assessments on the property benefited. In addition, the
cost of the water line, fire hydrants and service connections
will be paid from a levy of assessments on the property, but
the City of Chubbuck will provide for the installation of the
same. The cost of installation is estimated to be
approximately $6500 and shall be paid from the City's
Waterworks Fund. Based upon the total project, the relative
percentage of total costs and expenses is as follows:

SECTION 3: Method of Assessment. The costs and expenses
of the improvements will be assessed against the abutting,
adjoining and adjacent lots and lands along or upon which such
improvements are to be made and upon lots and lands benefited
by such improvements and included in the district to be
created. The assessment will be made on the basis of frontage
foot along Homestead Road, except that the properties
comprising the west 325 feet of Homestead Road will not be
assessed any part of the cost of the sewer construction since
they will derive no benefit therefrom. All of the cost of the
sewer constNuction will be apportioned to the property
adjoining the easterly 975 feet of Homestead Road within the
local improvement district, on the basis of frontage foot
along Homestead Road. All other costs in the local
improvement district as set forth in the preceding section,
will be allocated to all properties within the local
improvement district on the basis of frontage foot along
Homestead Road.
SECTION 4: Notice of Hearing. Any owner of property to
be assessed in the proposed Homestead Road local improvement
district described above, shall have the right to file in
writing a protest to the creation of the district or making
any other objections in relation thereto. On August 9, 1983,
at 7:30 P.M. in the Chubbuck City Offices, located at 5160
Yellowstone, Chubbuck, Idaho, the Chubbuck City Council shall,
in open and public session consider all protests which have
been filed in writing in advance of the hearing. Any property
owner who fails to file a protest within the time specified,
or, having filed one, withdraws said protest, shall be deemed
to have waived any objection to the creation of the district,
the making of the improvements, and the inclusion of his or
her property in the district. Such waiver shall not preclude
his or her right to object to the amount of the assessment at
a later hearing provided for such purpose.
ADOPTED BY THE COUNCIL AND APPROVED BY THE MAYOR, at the
