M. Mc(Xaber, executed a deed to the Village of Chubbuck, a
municipal cor~oration, duly authorized and ex/sting under the
laws of the S~ate of Idaho, County of Bannock, to the following

~, it was represented to Denzil A. Kurtz and Verde R.
Kunz that the deed would not be recorded unless .s~$!ar..deeds ........
were e.w~cut~d-'by-ad, oiling land owners fo~ 'the es~abliShment
of a street within the Village of Chubbuck and would not be
recorded until the Village of Chubbuck had accepted the Deed
and agreed ~o mmin~in and establish a street~ and
~JtS, it appears that the Village of Chubbuck has not
accepted the ~aid real estate from Denzil A. Kunz and Verde
lt. K~rm for the purpose of establAshin~ a public streetl and
~alEIFJ~, it' appears that the deed was recorded by the
Bannock County Clerk without the knowledge amd consent of
Dermil A; Kurtz end Verde R. Kunz and the Village of Chubbuck,
a municipal corporation ~ and
WS~aS, the Village of Chubbuck does not desire to
establish and &meuse the construction of a street at this
time and does not desire to accept the lend and did et no
time authorize the recordin~ of said
~HELtF~, it is the desire of the Village Board of the
Village of Chubbuck, acting under its duly appointed municipal
officers to reconvey the land to Denzil A. Kunz and Verde R.
Kunz.

NOW, THEREFORE, be it resolved that the Chairman or
acting Chairman of the Village Board of the Village of
Chubbuck, County of Bannock, Stats of Idaho, be authorized
to execute any and all papers necessary to reconvey the
following described property to Denzil A. Kunz and Verda
R. Kunz =
Beginning at the North.eat 1/16 corner of
Section 10, Township 6 South, Range 34 E.B.M.
Thence North along the East 1/16 line of said
Section 10, 117.21 feet; Thence South 89 deg.
17 min. East 25.0 feet~ Thence South parallel
to the said East 1/16 line 245.21 feet, more
or lees, to a point on a line having a bearing
of South 89 deg. 17 min. East from a point on
the East 1/16 line which is 128.0 feet South
of the point of beginning. Thence North 89
deg. 17 min. West 25.0 feet more or 1Qss to
the said East 1/16 line; Thence North along
the East 1/16 line 128.0 feet more or less to
the Point of Beginning·
AND, BE IT FURTH~ RESOLVED that the Clerk of the
Village B~a~'of the Village of Chubbuck, is authorized
to deliver .said~ dee~ to Denzil A. Kurtz and Verde R~ Kurtz ....
for recording for the purpose of removing the cloud to
the title to their land which has resulted in the unauthorized
recording of the deed.
