AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ADOPTING SECTION
9.04.020 DEFINITIONS TO PROVIDE THAT IN ALL PROVISIONS OF THE
CHUBBUCK MUNICIPAL CODE, INCLUDING ALL PROVISIONS OF TITLE 9
RELATING TO THE GENERAL CRIMINAL CODE, TITLE 6 RELATING TO
DAYCARE, AND TITLE 8 RELATING TO HEALTH AND SAFETY, WHERE
"CHIEF'S DESIGNEE" IS USED TO INDICATE A DESIGNEE OF THE CHIEF OF
POLICE, IN ALL INSTANCES THAT "DESIGNEE" SHALL BE A MEMBER OF OR
EMPLOYEE OF THE CITY OF CHUBBUCK IN GENERAL AND THE CHUBBUCK
POLICE DEPARTMENT SPECIFICALLY; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF
THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL
BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. New Section 9.04.020
The following Section 9.04.020 is added to the Chubbuck Municipal Code:
9.04.020 Definitions. In all instances in the Chubbuck Municipal Code, including but
not limited to Title 9 General Criminal Code, Title 6 Daycare, and Title 8 Health and Safety,
where a reference is made to the "Chief of Police or the Chiefs designee," that designee shall be
an employee of the City of Chubbuck and a member or employee of the Chubbuck Police
Department.

ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting_ Ordinances. The provisions of any Ordinance of the
City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
Section 2. Severability. If any provision of this ordinance is held invalid, for any reason,
by any court of competent jurisdiction, such holding shall not affect the validity or enforceability
of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication as provided by law.
PASSED BY THE COUNCIL AND APPROVED BY THE MAYOR OF THE CITY OF
CHUBBUCK, IDAHO, this 8TH day of OCTOBER , 2002.
