AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING
FOR CERTAIN LANDS KNOWN AS THE BOHRER TRUST PROPERTY
WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK BE RE-
ZONED AND CHANGED FROM MULTIPLE-FAMILY RESIDENTIAL-
LIVESTOCK (R-3L) TO COMMERCIAL GENERAL (C-3); AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1: Re-Zoning. The following described lands
known as the Bohrer trust property within the boundaries of
the City of ChUbbuck, Idaho, are hereby re-zoned to change
from Multiple-Family Residential-Livestock (R-3L) to Commercial
General (C-3):
A tract of land in the SW 1/4 of Section 10,
Township 6 South, Range 34 E., B.M., Bannock
County, Idaho, more particularly described as
follows:
Commencing at the south quarter corner of Section
10, Township 6 South, Range 34 E., B.M., thence
south 89°36' west 0.7 feet, more or less, to the
westerly right of way of Pole Line Road; thence
north 1°17' east, along said right of way of Pole
Line Road, 625 feet to the true point of beginning;
thence south 89036' west, 633.92 feet; thence
south 44038' west, 472.5 feet, more or less, to
the center line of U.S. Government Lateral (Fort
Hall Project - O'Leary Lateral "X"); thence north
53055' west along said lateral center line 1269
feet, more or less, to the west boundary of the
east half of the SW 1/4 SW 1/4 of the said Section
10; thence north 0043' west 283.8 feet, more or
less, to the northwest corner of the said east
half of the SW 1/4 SW 1/4; thence north 89'°15'
east along the north line of the said SW 1/4 SW
1/4, 658 feet, more or less, to the southwest 1/16
corner of the said Section 10; thence north 0~01'
east, along the west 1/16 line of the said Section
10, 1159 feet, more or less, to the southerly
right of way of Interstate Highway 1-15W; thence
south 80°32'11'' east, 261.91 feet; thence south
38°22' east 828.47 feet; thence south 44054' east,
335.1 feet; thence south 88~47' east, 280.3 feet,
more or less, to the westerly right of way line of
the Yellowstone Park Highway; thence southwesterly
along the said Yellowstone Park Highway right of
way 922.1 feet, more or less, to the point of
beginning.
SECTION 2: Effective Date. The rule requiring ordinances
to be read on three separate dates is hereby dispensed with,
and this ordinance shall beco~effective upon its approval
and publication as provided by law.
