AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING
FOR CERTAIN LANDS AND PROPERTY WITHIN THE BOUNDARIES OF
THE CITY OF CHUBBUCK PRESENTLY OWNED BY WILLIAM ARMSTRONG
AND PHYLLIS ARMSTRONG (HUSBAND AND WIFE) TO BE RE-ZONED
AND CHANGED FROM GENERAL COMMERCIAL (C-3) IN PART AND
COMBINED RESIDENTIAL (R-2) IN PART, TO GENERAL CO~.~ERCIAL
(C-3) IN THE ENTIRETY; PROVIDING FOR CERTAIN LANDS AND
PROPERTY WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK
PRESENTLY OWNED BY MOBILE MANOR, INC., TO BE RE-ZONED
AND CHANGED FROM COMBINED RESIDENTIAL (R-2) TO MOBILE-
HOME RESIDENTIAL (R-2T); AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1: Armstrong Property. That the following
described lands and property within the boundaries of the
City of Chubbuck, Idaho, presently owned by William Armstrong
and Phyllis Armstrong (husband and wife), be re-zoned and
changed from General Commercial (C-3) in part and Combined
Residential (R-2) in part, to General Commercial (C-3) in
the entirety:
A tract in the northeast quarter of the southwest
quarter of Section 3, Township 6 South, Range 34 E.B.M.,
in Idaho, particularly described as follows, to-wit:
Beginning at the northeast corner of the South 23 rods
of said northeast quarter of the southwest quarter of
Section 3, run thence west along the north boundary
line of the James E. Harrington et. al. property,
described in that certain deed recorded in Book 99 of
Deeds, Page 506 of the Records of Bannock County,
Idaho, a distance of 438.5 feet, run thence at right
angles in a northerly direction a distance of 85 feet,
run thence at right angles in an easterly direction,
parallel with the north boundary line of the Harrington
tract above referred to, a distance of 438.5 feet to
the east boundary of the said northeast quarter of the
southwest quarter of Section 3, run thence in a southerly
direction along said east boundary line a distance of
85 feet to the Place of Beginning. Subject to any
ditches or laterals or other rights of way upon, over
or across said lands as the same now exist, and particularly
subject to the right of way for the Yellowstone Highway.
SECTION 2: Mobile Manor First Addition. That the
following described lands and property within the boundaries
of the City of Chubbuck, Idaho, presently owned by Mobile
Manor, Inc., be re-zoned and changed from Combined Residential
(R-2) to Mobile-Home Residential (R-2T):
Lot 22, Block 4, Mobile Manor First Addition, as the
same appears in the subdivision plat thereof duly filed
and recorded at the office of the Bannock County Recorder.
SECTION 3: That the rule requiring ordinances to be
read on three separate days is hereby dispensed with, and
this ordinance shall become effective upon its approval and
publication as provided by law.
PASSED BY THE MAYOR AND COUNCIL of the City of Chubbuck,
Idaho, this 19th day of December, 1975.
