AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING CERTAIN
LANDS TO BE INCLUDED WITHIN THE BOUNDARIES IN JURISDICTIONAL
LIMITS OF THE CITY OF CHUBBUCK, IDAHO, RECENTLY EXCLUDED
FROM THE CITY OF POCATELLO, IDAHO, AND LYING WITHIN THE
QUINN ROAD, HAWTHORNE ROAD, AND POLELINE ROAD RIGHTS-
OF-WAY; ANNEXING CERTAIN LANDS TO BE INCLUDED WITHIN THE
BOUNDARIES AND JURISDICTIONAL LIMITS OF THE CITY OF CHUBBUCK,
IDAHO, LOCATED IN BANNOCK COUNTY, IDAHO, AND LYING WITHIN
THE HAWTHORNE ROAD RIGHT-OF-WAY; PROVIDING THAT SAID LANDS
NEWLY ANNEXED TO THE CITY OF CHUBBUCK LIE WITHIN AND CONSTITUTE
PUBLIC RIGHTS-OF-WAY AND AS SUCH DO NOT REQUIRE ZONING
CLASSIFICATION; DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY
WITH THE FILING REQUIREMENTS CONTAINED IN IDAHO CODE SECTION
63-2215; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1: Annexation of. lands •excluded -from the City
of Pocatello. The following described lands, located within
Bannock County, Idaho, and contiguous to the existing boundaries
of the City of Chubbuck, Idaho, which have recently been
excluded from the City of Pocatello, Idaho, are hereby
annexed and included within the boundaries and jurisdictional
limits of the City of Chubbuck, Idaho:
Beginning at= _:the Nbrtl = A/W Quinn' Raad - arid` the `nest;
R/W_ Hawthorne Road which is the TRUE POINT OF BEGINNING;
Thence North along the West R/W of Hawthorne Road to I -15's
South R/W to the Centerline of Hawthorne Road; Thence South
along Hawthorne Road's Centerline to a point in line with
Quinn Road's North R/W; Thence West and in line with Quinn
Road's North R/W to the TRUE POINT OF BEGINNING. The above
described portion of Hawthorne Road contains 1.38 acres,
more or less.
Beginning at the intersection of the north R/W line of Quinn
Road and the Went R/W line of Poleline Road which is the
TRUE POINT OF BEGINNING; Thence North along the West R/W of
Poleline Road to the Southerly R/W of Yellowstone Park Hwy.
(U.S. 91-191); Thence Easterly along said Hwy. R/W to the
East R/W Line of Poleline Road; Thence South along Poleline
>o Road's East R/W to the North R/W of Quinn Road; Thence West
jAz across Poleline Road 66 ft. and in line with Quinn Road's
North R/W to the TRUE POINT OF BEGINNING. The above de-
o�� scribed portion of Poleline Road contains 0.80 acres, more

SECTION 2: Annexation of other lands within Bannock
County. The following described lands. located within
Bannock County, Idaho, and contiguous to the existing boundaries
of the City of Chubbuck, Idaho, are hereby annexed and
included within the boundaries and jurisdictional limits of
the City of Chubbuck, Idaho:
Beginning at the North R/W Quinn Road and the East
R/W Hawthorne Road which is the TRUE POINT OF BEGINNING;
Thence North along the East R/W of Hawthorne Road to j
I -15's South R/W to the Centerline of Hawthorne Road; Thence
South along Hawthorne Road's Centerline to a point in lin
with Quinn Road's North R/W; Thence East along Quinn Roadls
North R/W to the TRUE POINT OF BEGINNING. The above de-
scribed portion of Hawthorne Road contains 1.38 acres, more
or less.
SECTION 3: Zoning. The above-described lands newly
annexed to the City of Chubbuck, Idaho, lie within and
constitute public rights-of-way; and as such, do not require
zoning classification.
SECTION 4: Compliance with state law. The Chubbuck
City Clerk is hereby directed to comply with the filing
requirements contained in Idaho Code Section 63-2215.
SECTION 5: Effective Date. The rule requiring that
ordinances be read on three separate days is hereby dispensed
with, and this ordinance shall become effective upon its
passage, approval and publication as provided by law.
PASSED BY THE COUNCIL AND APPROVED BY THE MAYOR of the City of
Chubbuck, Idaho, this 15th day of January, 1976.

S:ec'ti.on G. That should any of the provisions of
this 'ordinance be held invalid for any cause, or should any
of this ordinance bedeclared invalid insofar as the .annexa-

tion or disannexation of any of the: above..described lands is
concerned, then such :declaration of invalidity shall not .
affect .annexation or disannexation of the. remainder or
balance :of..the said lands described in this ordinance.

and said Clerk 'is hereby directed, to:file wi:th.the Bannock
County. Auditor, Treasurer and Assessor, and with :the Idaho
State Tax Commission, in accordance with '.I.C.. 50 -?2-23 and I.C.
63-2:215, a certified copy of this_ordinance,.:duly .and properly
certified byy him.and under. the:corpor.ate:seal of the said City,
and, immediately:thereafter, ,the incorporated limits: of said
City. of Pocatello .shall extend to. and include the annexed lands
above. described and shall exclude .the disannexed lands above
described,and all of .them, and.the:rafter.all property within
the limits of .the said annexed lands shall be subject to. all
of the provisions of said City. of Pocatello and to: the .police
regulations theseo.f; and all property- disannexed and removed
from the City.of Pocatello shall no longer be subject to. the
provisions of the .City. or .its police regulations,: except any
bonded indebtedness or special assessments. outstanding in
