AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING
CERTAIN LANDS KNOWN AS THE "STEPHENSON PROPERTY" AND
ANNEXING CERTAIN OTHER LANDS KNOWN AS THE "ALTURAS PARK
PROPERTY" TO BE INCLUDED WITHIN THE BOUNDARIES AND
JURISDICTIONAL LIMITS OF THE CITY OF CHUBBUCK, IDAHO;
SPECIFYING THE ZONING CLASSIFICATIONS WHICH SHALL BE
APPLIED TO SAID LANDS NEWLY ANNEXED TO THE CITY OF
CHUBBUCK; DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY
WITH THE FILING REQUIREMENTS CONTAINED IN IDAHO CODE
SECTION 63-2215; AND PROVIDING WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1: Annexation.
A. "Stephenson Property." The following described
lands, located within Bannock County and contiguous to the
existing boundaries of the City of Chubbuck, Idaho, are
hereby annexed and included within the boundaries and the
jurisdictional limits of the City of Chubbuck, Idaho:
That portion of the SE1/4 of the SW 1/4,
Section 4, Township 6 South Range 34 East,
Boise Meridian, Bannock County, Idaho, described
as follows:
Beginning at a point 25 feet North 0005' West
of the South quarter corner of said Section
4, said point being on the North right of way
line of Chubbuck Road and the meridianal
centerline of said Section 4; thence North
0005' West along said meridianal centerline
586.46 feet; thence North 87°17' West, 210.49
feet; thence South 0°16'15'' East, 596.00
feet, more or less, to a point on said North
right of way line; thence South 89054' East
along said North right of way line 208.10
feet, more or less, to the Point of Beginning..
B. "Alturas Park Property." The following described
lands, located within Bannock County and contiguous to the
existing boundaries of the City of Chubbuck, Idaho, are
hereby annexed and included within the boundaries and the
jurisdictional limits of the City of Chubbuck, Idaho:
Commencing at the South 1/4 corner Section 4,
Township 6 South, Range 34 East, Boise Meridian;
%hence West 208.10 feet to the True Point of
Beginning; thence North 586.41 feet; thence
East 208.10 feet; thence North 2053.54 feet;
thence West 511.5 feet; thence South 2640
feet; thence East 303.40 feet, more or less
to the Point of Beginning.
SECTION 2: Zoning.
A. The above-described lands herein termed the
"Stephenson Property," newly annexed to the City of Chubbuck,
Idaho, shall be subject to the zoning classification of
combined residential-livestock (R-2L).
B. The above-described lands herein termed the
"Alturas Park Property," newly annexed to the City of Chubbuck,
Idaho, shall be subject to the zoning classifcation of
Combined Residential (R-2).
SECTION 3:' Filing. The Chubbuck City Clerk is hereby
directed to comply with the filing requirements contained in
Idaho Code section 63-2215.
SECTION 4: Effective Date. The rule requiring ordinances
to be read on three separate days is hereby dispensed with,
and this ordinance shall become effective upon its approval
and publication as provided by law.
