HomeMy WebLinkAbout0177 Area of Impact 1977ORDINANCE NO. 177 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, DEFINING A GEOGRAPHICAL AREA OF CITY IMPACT; IDENTIFYING THE COMPREHENSIVE PLAN THAT SHALL APPLY WITHIN THE UNINCORPORATED PORTION OF BANNOCK COUNTY; IDENTIFYING THE ZONING AND SUBDIVISION ORDINANCE THAT SHALL APPLY WITHIN THE UNINCORPORATED PORTION OF BANNOCK COUNTY; AND ESTABLISHING AN EFFECTIVE DATE PURSUANT TO SECTION 67-6526, IDAHO CODE. BE IT ORDAINED by the Mayor and City Council of the City of Chubbuck, Idaho: SECTION 1. PURPOSE The purpose of establishing an area of city impact is to identify an urban fringe area adjoining the City of Chubbuck. Said urban fringe area, outside the incorporated limits of the City of Chubbuck, lis creating a need for expanded and more intense urban services, and demands closer cooperation between;said city and Bannock County. Section 67-6526, Idaho Code, requires cities and counties negotiate an area of city impact to achieve closer cooperation. SECTION 2. CONSIDERATION The following factors were considered by the Planning Commission, the City Council and Bannock County Board of Commissioners in the establishment of an area of city impact: A. Trade area; B. Geographic factors; C. Areas that can reasonably be expected to be annexed into the city in the near future. SECTION 3. GEOGRAPHIC AREA OF CITY IMPACT The officially adopted geographic area of city impact is shown on the attached map entitled, "Area of City Impact of Chubbuck, Idaho" (Section 3-A), and is specified in the attached "Legal Description" (Section 3-B). SECTION 4. COMPREHENSIVE PLAN The comprehensive plan and subsequent amendments thereto as officially developed with Chubbuck's review and adopted by Bannock County, Idaho, shall apply to said area of city impact. SECTION 5. ZONING AND SUBDIVISION ORDINANCES The zoning and subdivision ordinances and subsequent amendments thereto as jointly developed and reviewed by the City of Chubbuck and Bannock County~ and officially adopted by Bannock County, Idaho, shall apply to the area of city impact within the unincorporated area of Bannock County, Idaho. The City of Chubbuck shall review all subdivisions in the impact area in a manner similar to that prescribed in Section 50-1308, Idaho Code. SECTION 8. EFFECTIVE DATE The requirement that an ordinance be read on three (3) seperate occasions is dispensed with, and this ordinance shall become effective upon its passage, approval ~ndPubl~atiOn!ias;;PrOvided by law.
