HomeMy WebLinkAbout0189 Zoning Mountain Park Subdivision 1978ORDINANCE NO. 189 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR CERTAIN LANDS WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK, PRESENTLY OWNED BY BUNCE, ALDER & BUNCE, INC., AND KNOWN AS THE PROPOSED "MOUNTAIN PARK SUBDIVISION", TO BE RE-ZONED FROM AGRICULTURAL TRANSISTIONAL (A-T) IN PART TO SINGLE FAMILY RESIDENTIAL (R-l) AND IN PART TO MULTIPLE FAMILY RESIDENTIAL (R3): DECLARING THAT THE CITY COUNCIL FINDS SUCH RE-ZONING NOT INCONSISTENT WITH THE LAND USE PATTERN PRESCRIBED IN THE CITY'S COMPREHENSIVE PLAN: AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION l: R-1Re-Zonin9. The following described lands or property within the boundaries of the City of'Chubbuck, Idaho, presently owned by Bunce, Alder and Bunce, Inc., comprising part of the proposed "Mountain Park Subdivision", are hereby re-zoned from Agricultural Transistional (A-T) to Single-Family Residential (R-l): A parcel of land situated in the east half northwest quarter, section 11, township 6 south, range 34 east, Boise Meridian, Bannock County, Idaho, more particularly described as follows: (Basis of bearing-north line section 11, south 89v 54' 10" east) Commencing at the north quarter corner of said section ll, said point being marked by a railroad spike; thence south 0° 01' 38" east, 754.03 feet to the true point of beginning, said point being the southeast corner of Mountlake Terrace Subdivision, as recorded in the office of the county recorder, Bannock County, Idaho; (said ~oint being marked by a found ½" iron pin.) Thence south 0u 00' 17" east, 1,752.48 feet to the northerly right-of-way line of interstate highway 86; (said point being marked by A 5/8" iron pin tagge~ LS #968.) Thence south 810 45' 09" west, along said northerly right-of-way line, 545.16 feet to a highway right-of-way brass cap monument, station 928 + 52.47 150 feet left; thence south 860 08' 15" west, along said northerly right-of-way line, 414.05 feet to a highway right-of-way brass cap monument, station 924 + 14.47, 200 feet left; thence south 83o 38' 31" west along said northerly right-of-way line 368.18 feet to its intersection with the west 1/16 line of said section 11; (said point being marked by A 5/8" iron pin tagge~ LS #968.) Thence horth OO 06' 34" 6ast, along the West 1/16 line of said section 11, 428.00 feet; Thence South 71o 50' 00" west, 121.45 feet to the easterly right of way of Hiline Road; Thence north 18° 19' 18" west, 50.00 feet along said easterly right of way; Thence north 71o 50' 00" east, 170.84 feet; Thence along a curve to the left having an arc length of 39.49 feet, said curve having a central angle of 900 30' 19", a radius of 25.00 feet, and a chord length of 35.51 feet; Thence north 18o 40' 19" west, 504.96 feet; Thence north 700 30' east, 123.00 feet; Thence north 0° 06' 34" east, 461.92 feet; Thence north 74o 58' 32" ~ast 517.96 feet; Thence south 890 55' 00" east 244.88 feet, to a found ½" iron pin; Thence north 0° 05' 29" east, 262.45 feet to the southerly boundary of said Mount Lake Terrace Subdivision, said point being marked by a 5/8" iron pin tagged LS #968; Thence south 89o 54' 21" east, along said southerly boundary, 569.99 feet to the point of beginning. Excepting therefrom, however, that parcel which is described in Section 2 of this Ordinance, below. SECTION 2: R-3 Re-Zoning. The following described lands within the boundaries of the City of Chubbuck, Idaho, presently owned by Bunce, Alder, and Bunce, Inc., comprising part of the proposed "Mountain Park Subdivision", are hereby re-zoned from Agricultural-Transistional (A-T) to Multiple-Family Residential (R-3): A parcel of land in the aforesaid section ll described as follows: Commencing at the intersection of the northerly right-of-way line of Interstate 86 with the west 1/16 line of said section 11. Said point being the true point of beginning; Thence N 0° 06' 34" £~, 454.33 feet; Thence N71o 50' E, 91.50 feet; Thence N18o 40' 19" E, 127.38 feet; Thence N71° 19' 41" E, 45.00 feet; Thence along a curve to the left having an arc length of 53.58 feet, said curve having a central angle of 22o 07' 36", a radius of 138.75 feet and a tangent length of 27.13 ~eet; Thence N49O 12' 05" E, 42.50 feet; Thence along a curve to the right having an arc length of 112.30 feet, said curve having a central angle of 19° 47' 55", a radius of 325.00 feet, and a tangent length of 56.72 feet; Thence N 690 00' E, 25.00 feet; Thence S 16u 28' 12" E, 525.00 feet; Thence N 800 10' 28" E, 112.00 feet; Thence along a curve to the left having an arc length of 88.60 feet, said curve having a central angle of 150 37' 08" a radius of 325.00 feet and a tangent length of 44.57 feet; Thence S 25° 26' 40" E, 25.00 feet; Thence S 50 52' 21" E 1 98.52 feet more or less along the west line of Lot 16 Block 9 of said Mountain Park Subdivision to the north right of way line of Interstate 86; Thence S 86° 08' 15" W, 296.21 feet along said right of way tine to a highway right of way brass cap monument, station 924 + 14.47, 200 feet left; Thence S 83o 38' 31" W, 368.18 feet along said right of way line to its intersection with the west 1/16 line of said section 11, the point of beginning. SECTION 3. Comprehensive Plan. The mayor and council find, and therefore declare, that the foregoing changes in zoning are not inconsistent with the land use pattern prescribed by the city's comprehensive plan, adopted by resolution in compliance with the Idaho Local Planning Act on June 13, 1978. SECTION 4: Effective Date. The rule requiring ordinances to be read on three seperate occasions is hereby dispensed with, and this ordinance shall become effective upon its approval and publication as provided by law.
