ORDINANCE NO. 194
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO ANNEXING
CERTAIN LANDS KNOWN AS THE "DELL ROAD AREA" TO BE
INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL
LIMITS OF THE CITY OF CHUBBUCK, IDAHO; SPECIFYING THE
ZONING CLASSIFICATIONS WHICH SHALL BE APPLIED TO SAID
LANDS NEWLY ANNEXED TO THE CITY OF CHUBBUCK;
DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY WITH THE
FILING REQUIREMENTS CONTAINED IN IDAHO CODE SECTION 63-
2215; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIl. OF THE CITY
OF CHUBBUCK, IDAHO;
SECTION 1: Annexation. The following described
lands, located within Bannock County and contiguous to the
existing boundaries of the City of Chubbuck, Idaho, are
hereby annexed and included within the boundaries and .jurisdictional
limits of the City of Chubbuck, Idaho:
Beginning at the East 1/4 corner of Section 4,
Township 6 South, Range 34 East, Boise Meridian;
thence 1320 feet, more or less to the East 1/16
corner on the latitudinal center line of said
Section 4; thence 1320 feet, more or less to the
Northeast 1/16 corner of said Section 4; thence
1320 feet more or less to the North 1/16 corner on
the East Longitudinal line of said Section 4;
thence 30 feet more or less to the Easterly right-
of-way line of Hawthorne Road; Thence Southerly
along said Easterly right-of-way line, 1320 feet
more-or-less to a point 30 feet more or less East
of the East 1/4 corner of said Section 4; thence
Westerly 30 feet, more or less to the East 1/4
corner of said Section 4, the point of beginning.
SECTION 2:
Zoning. The above-described lands
herein termed the "Dell Road Area", newly annexed to the
City of Chubbuck, Idaho, shall be subject to the zoning
classification of agricultural-transitional (A-T), except
that the zoning classification of combined residential--
livestock (R-2L) shall be applied to that portion of said
lands comprised of the Del Mar Acres Subdivision as the same
is platted and recorded in the office of the County Recorder,
Bannock County, Idaho.
SECTION 3: Fil~Dg. The Chubbuck City Clerk is
hereby directed to comply with the filing requirements
contained in Idaho Code section 63-2215.
SECTION 4. Effective Date. This ordinance shall
become effective upon its passage, approval and publication
as provided by law.
PASSED BY THE COUNCIL AND APPROVED BY THE MAYOR of the
City of Chubbuck, Idaho, this 13th day of February, 1979
