HomeMy WebLinkAbout0110 Commercial Kennel License 1972 ORDINANCE NO. 110 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, T© PROVIDE A DEFINITION OF A COMMERCIAL KENNEL; CONDITIONS FOR THE ISSUANCE CF A COMMERCIAL KENNEL LICENSE; AND REGULATIONS FOR D©C~q SHOWING SYMPTOMS OF RABIES. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO, to-wit: Section 1. That Section 7 of Ordinance No. 109 of the City of Chubbuck, Idaho, be deleted in its entirety and the following inserted in lieu thereof: A commercial kennel shall be defined as any lot or premises or portion thereof on which three (3) or more dogs, cats, and other household domestic animals are maintained, harbored~ possessed, boarded, bred, or cared for in return for compensation or kept for sale. Provided, however, that a duly licensed veterinary clinic shall not be considered to be a commercial kennel. No commercial kennel shall be allowed within the City without a permit. An application for said permit shall be made to the city Planning and Zoning Commission. The Planning and Zoning Commission shall conduct such invest- igation and or hearings as it deems necessary and shall there- after forward the application to the City Council with its recommendation. If the City Council shall determine that the issuance of such permit is in the interest of the com- munity and is not detrimental to the surrounding property it shall upon payment by the applicant of such license fee as shall be established by the Council issue the permit. Section 2. That Section 9 of Ordinance No, 109 of the City of Chubbuck, Idaho, be deleted in its entirety and the following inserted in lieu thereof: Secti~ 9-the poundmaster shall have authority to order the owner of any dog showing symptoms of rabies or of any dog which has bitten any person or persons so as to cause an abrasion of the skin, to confine such dog to such location as the animal control officer acting in compliance with regulations of the Department of Health shall direct for a period not to exceed ten (10) days, and if such dog shall be determined to be free of rabies the same shall be returned to the owner upon payment of the fees required for keeping dogs impounded. No other fees shall be charged. If the fee is not paid the dog shall be subject to disposal as provided for in Section 10 of Ordinance No. 109 of the City of Chubbuck, Idaho. Provided, however, that in lieu submitting such dogs to the city pound the owner may at his expense submit such dog to a duly licensed veterinarian for examination. Any dog found to be afflicted with rabies shall be disposed of in accordance with regulations of the Idaho State Department of Health.
