AN ORDINANCE OF THE CITY CF CHUBBUCK, IDAHO. LIMITING
THE KINDS OF LIVESTOCK WHICH CAN BE RAISED IN THE CITY
OF CHUBBUC~. IDAHO~ ESTABLISHING ANIMAL UNITS ~
ESTABLISHING MINIMUM L¢3T SIZES FOR THE RAISING OF
ANIMAL UNITS AND REGULATING THE USE THEREOF.
BE IT ORDAINED BY THE MAYOR AND CC. UNCIL OF THE CITY
OFCHUBBUCK, IDAHO, AS FOLLOWS:
Section 1. The purpose o~ this ordinance is to promote
pride of ow~ership, health, sanitation, safety, morale, and
general welfare, of the people of Chubbuck, Idaho, and farm
livestock residing within its area of Jurisdiction·
Section 2. The keeping of farm livestock in the City
of Chubbuck is recognized as a use of the land and is therefore
subject to the specific and special standards as herein provided.
The following livestock and no thers (excepting household
pets) shall be allowed to be kept within the city limits of the
City of Chubbuck, Idaho
A. Cows inclusive of all bovines.
B. Sheep inclusive of all ovines.
C. Goats inclusive of all caprlne.
D. Rabbits and/or fowl inclusive of all chickens,
ducks, geese and pigeons.
E. Horses inclusive of all equine.
Section 3. For purposes of the statute the following
definitions shall apply:
Cows inclusive of all bovines.
a. From birth to one (1) year of age, one-half
(%) animal unit·
b. One (1) year of age and older, one (1)
animal unit.
Sheep inclusive of all ovine.
a. From birth to one (1) year of age, one-fourth
(¼) animal unit·
b. One (1) year of age and older, oneOhalf (½)
animal unit.
Gcats inclusive of all caprine.
a.. From birth to one (1) year of age, one-fourth
(¼) animal unit·
b. One (1) year of age and older, one-half (½)
animal unit.
Rabbits and/or fowl inclusive of all chickens,
ducks, geese and pigeons.
a. 25 of any species or combination therof, one
(1) animal unit.
Horses inclusive of all equine·
a. From birth to one (1) year of age, one-half
(½) animal unit·
b. One (1) year of age and older, one (1) animal
unit.
Section &. The kee~ing of any of the above livestock
shall be permitted only in areas zoned for livestock and the
following minimum standard ]~equirements shall apply:
1. No animals as enumerated above shall be allowed
on any lot of less than 15,000 sq. feet.
2. Not more than one 'animal unit shall be kept on
a lot consisting in area of 15,O00 to 21,779 sq. feet.
Provided, however, that the said animal unit shall be
enclosed in a ~mn or corral containing in at least
800 sq. feet.
3. Not more than two animal units shall be kept on
a lot having an a~ea of 21,780 to 29,999 sq. feet,
provided that said animals are enclosed in a pen or
corral at least 800 sq. feet per animal unit.
&. Not more than three animal units shall be kept
on a lot consisting of an area of 30,000 to &3,559
sq. feet, provided that said animals are enclosed
in a pen or corral containing at ].east 800 sq. feet
per animal unit.
5. Not more than four animal units shall be kept
on a lot having an area of at ]east one acre to
560 sq. feet, provided that said animals are enclosed
in a ~n or corral containing at least 800 sq. feet
per animal unit.
6. Five (5) or more animal units shall require at
least ½ acres (21,780 sq. feet) per animal unit
provided they are enclosed in a pen o~. corral con-
taining at least 800 sq. feet per animal unit.
7. For any subdivision passed and approved after the
date of this ordinance no livestock shall be kept on
any lot smaller than the ½ acre.
Section 5. All sheds, stables, corrals, pens, coops,
for animals enumerated herein shall be not less than 50 feet from
any human inhabitants structure. Fences for l,ens, corrals, or
similar enclosures must be of sufficient height and strength
to retain the animals. All structures including sheds, corrals,
and stables, shall be constructed and maintained so as not to
distract from the beautification of the surrounding area. Standings
under roofed stables or sheds and pens or corrals shall be provided
with proper drainage so it does not create offensive odors,
fly breeding, or other nuisances.
Section 6. The provisions of this ordinance shall
not at,ply to animals being treated at a duly licensed veterinary
hospital, or to special events which are otherwise regulated by
the City Council, including but not limited to surface rodeos,
or livestock expeditions.
Section 7. It is hereby provided that any person
keeping livestock on the effective date of this o~dinance in
a zone in the City of Chubbuck which is zoned to exclude live-
stock shall be given a period of 12 months from the effective
date of this ordinance, or until such animal shall die or the
owner thereof shall transfer the same, which ever shall first
occur to remove the said animals.
Section 8. Should any section, subsection, sentence,
provision, clause or phrase of this ordinance be held to be
invalid for any reason, such holding shall not render invalid
any other section, subsection, sentence, provision, clause or
phrase of this ordinance and the same for this purpose are
deemed to be severable.
Section 9. Any person, persons or corporation who
shall violate any of the provisions of this ordinance or fail to
comply therewith, or with any of the requirements thereof, shall
be guilty of a misdeameanor and shall be upon conviction thereof
liable to a fine of not more than Three Hundred Dollars ($300.0Q)
and each day such violation shall be permitted to exist shall
constitute a separate offense. The City likewise shall have
the power to enforce the provisions of this ordinance through
civil court action as provided by law.
