ORDINANUE OF THE CITY OF CHUBBUCK, IDAHO, REGULATING THE MOVING OF
BUILDINGS OR STRUCTURES WITHIN OR INTO THE CITY OF CHUBBUCK; PRO-
VIDING FOR ANY PERSON S~ING TO MOVE BUILDINGS OR STRUCTURES TO
ADVISE THE CITY CLERK OF THE PRESE~ LOCATION AND FUTURE DESTINA-
TION OF THE BUILDING OR STRUCTURE TO BE MOVED; PROVIDING FOR THE
CITY OF CHUBBUCK TO CAUSE THE BUILDING OR STRUCTURE TO BE INSPECTED
TO CC~PLY WITH ALL APPLICAH~E CODES; PROVIDING FOR THE OWNER TO
GUARANTEE THAT THE BUILDING OR STRUCTURE W1~.7. RE BROUGHT INT0 COM-
PLIANCE WITH BUILDING CODES AND ZONING REGULATION; PROVIDING FOR A
BOND, IF NECESSARY, FOR THE GUARANTEE THAT SAID BUILDING W1V.L COMPLY
WITH BUILDING CODES AND ZONING REGULATIONS; PROVIDING FOR A PENALTY
FOR VIC~ATION OF SAID ORDINANCE. PROVIDING EFFECTIVE DATE OF
ORDINANCE. THIS ORDINANCE SHALL BECOME EFFECTIVE UPON ITS PASSAGE,
APPROVAL AND PUHEICATION AS ~PROVIDED BY LAW, THE RULE REQUIRING
READING ON THRkTM SEPARATE DAYS HAVE BEEN DISPENSED WITH.
IT APPEARING TO THE MAYOR AND CITY COUNCIL OF THE CITY OF CHUBBUCK,
IDAHO, THAT IN ORDER TO PROTECT THE RESIDENTS OF CHUBBUCK, IDAHO,
AND TO PR~ DEVALUATION OF PROPERTY VALUES AND TO PROMOTE THE
GENERAL WEEFARE OF THE CITY OF CHUBBUCK AND ITS RESIDENTS, THAT IT
IS NECESSARY AND DESIRABLE TO ENACT AN ORDINANCE REGULATING THE
MOVING OF BUILDINGS OR STRUCTURES WITHIN THE CITY OF CHUBBUCK OR
INTO THE CITY OF CHUBBUCK.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
CHUBBUCK, IDAHO:
Section 1. No person, corporation, or association shall move
or cause to be moved any building or structure into or within the
City of Chubbuck, Idaho, without first notifying in writing the
City ~erk of the City of Chubbuck the present location and future
destination of the building or structure to be moved.
Section 2. Upon receiving the written notification referred
to in Section 1, the City of Chubbuck shall cause the building or
structure.to be inspected and examined by the building inspector
to determine whether the same will comply with all building codes
and other applicable codes; and further to determine that the
proposed building or structure will be consistent with the type
of buildings or structures in the area to which it will be moved
so as not to depreciate the value of surrounding property and to
insure that it will meet with applicable zoning regulations of the
City of Chubbuck.
Section 3. The owner shall provide the City of Chubbuck
with a guarantee in such form as may be approved by the City
of Chubbuck, guaranteeing that the owner will bring the building
or structure into compliance with the building codes and other
applicable codes and further guaranteeing that said building or
structure will be brought into such compliance promptly and in
no case later than one year after permission to move the same
has been granted as hereinafter provided.
Section 4. The City of Chubbuck may, in its discretion,
require the owner to provide a good and sufficient surety
bond or cash in an amount to be determined by the City of
Chubbuck from information furnished by the buLlding inspector,
based upon the estimated cost that will bring the building or
structure into compliance with the building codes, but such
surety bond or cash shall not exceed the sum of $5,000.00.
Section 5. Upon the owner complying with the foregoing
provisions of this ordinance, the City of Chubbuck through
the City Clerk or building inspector shall cause a permit to
be issued authorizing said owner to move said building er
structure from its present locatin to the future destination
provided in the written notification in Section 1 hereof.
Section 6. A violation of any provisions of this
erdinance shall constitute a misdemeanor, and each day such
violation shall be permitted to exist shall constitute a
separate offense. The City of Chubbuck shall likewise have
the power or right to bring an action in the appropriate Court
for injunctive relief, or otherwise, to enforce the provisions
of this Ordinance.
