HomeMy WebLinkAbout0133 Reception Centers 1974ORDINANCE NO. 133 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING ORDINANCE NO. 98 OF THE CITY OF CHUBBUCK, IDAHO, TO INCLUDE RECEPTION CENTERS AMONG THE CONDITIONAL USES PERMITTED IN AREAS ZONED RESIDENTIAL EXCEPT R-1 (SINGLE- FAMILY RESIDENTIAL); DEFINING A "RECEPTION CENTER" FOR THE PURPOSE OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1: That Chapter 1, Section 4(B), of Ordinance No. 98 of the City of Chubbuck, Idaho, passed and approved on the 28th day of September, 1971, is hereby amended as follows: B. Conditional Uses Permitted: The Planning Commission may, after proper notice and public hearing as prescribed in Chapter 3, Section 2, permit the following uses where such uses are deemed essential or desirable to the public convenience or welfare. The Commission shall have the authority to impose such conditions and safeguards as it deems necessary to protect the best interests of the surrounding property or neighborhood from damage, hazard, nuisance or other detriment. Those uses requiring Conditional Use Permits and as regulated therein in the R-1 District; Multiple-family dwellings limited to not more than 4 units; 3. Convalescent home; nursing home; Homes for ambulatory aged; rest home; elderly housing; 5. Hospital; One (1) sign not to exceed thirty-two (32) square feet in an area pertaining to the sale or lease of the building or premises where the sign is located. Signs shall be nonrevolving and indirectly lighted. Signs may be permitted to exceed this size if allowed by Conditional Use Permit; SECTION 2: ~e~eption center. That Chapter 4, Section 5(a), of Ordinance No. 98 of the City of Chubbuck, Idaho, passed and approved on the 28th day of September, 1971, is hereby amended to include the following additional definition: Reception Center - A permanent structure on fixed foundation util'ized exclusively for weddings, wedding receptions and anniversary parties; provided, that when such a structure is' actually used for all of these functions it may also be used for meetings of private clubs or public service organizations at which the' aggr.e.~atle attendance does not exceed 100 ~ersons. No such structure shall qualify as a ."reception center" if any alcoholic beverages are sold, consumed, or served in said structure or upon the' premises. SECTION 3: That the rule requiring ordinances to be read on three separate days is hereby dispensed with, and this ordinance shall become effective upon approval and publication as provided by law.
