RESOLUTION No. 1-2005
WHEREAS, the Public Works Director has received a report from Keller Associations,
Inc., Consulting Engineers, regarding the alternatives to water reservoirs on East Chubbuck
Road;
WHEREAS, the comparison between building a new reservoir is estimated to be
approximately $650,000 compared to the estimate for the costs of rehabilitation of the existing
partially-buffed concrete reservoir of $330,000;
WHEREAS, the City, as part of its governing duties, is charged with providing a safe
potable water supply and with supplying adequate fire protection within the City limits;
WHEREAS, the reservoir can be worked on safely prior to mid- to late April and after
mid- to late October and the City has applied for a loan from the Department of Environmental
Quality for purposes of pursuing this i'ehabilitation project;
WHEREAS, that loan will require judicial confirmation which cannot be accomplished
soon enough to allow the rehabilitation of the existing concrete reservoir to begin prior to the
summer of 2005;
WHEREAS, the City may pursue interim financing sources pending the approval and
judicial confirmation of the loan through the Department of Environmental Quality;
NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of
Chubbuck as follows:
1. The City shall cause to be heard at public hearing on March 8, 2005, at the hour of
7:30 PM, whether or not the City should proceed with the rehabilitation of the partially-buffed

concrete water storage reservoir on East Chubbuck Road, whether it should enter into a loan
agreement with Idaho Department of Environmental Quality to finance the project and whether it
should file a petition pursuant to the Idaho Judicial Confirmation Law. The form of the Notice of
Public Hearing is attached as an exhibit to this Resolution. The appropriate City official shall
cause the Notice of Public Hearing to be published in the Idaho State Journal and said Notice to
be sent by certified mail to all persons who have requested notice at least 14 days prior to the
date the public heating shall be held.
2. Additionally, the same shall be posted in a prominent place on or near the main
door of the City administrative offices as is routinely done by the City Clerk for public heating
notices.
3. The appropriate City officials are further authorized to pursue interim financing
with local lending agencies to arrange for financing of the project and commencement of
construction work prior to the time the loan with the Idaho Department of Environmental Quality
is finalized and judicial confirmation of the project is obtained.
