BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF
CHUBBUCK THAT SECTION 3 -1 -32: WATER RATES INSIDE CITY LIMITS:
OF ORDINANCE NO. 78 OF THE CITY OF CHUBBUCK BE AND THE SAME IS
HEREBY REPEALED. THAT IN LIEU, AND IN PLACE THEREOF, THERE IS
HEREBY RE- ENACTED SECTION DESIGNATED 3 --1 -32 OF ORDINANCE NO. 78
OF THE CITY OF CHUBBUCK:TO READ AS FOLLOWS:

WATER RATES INSIDE CITY LIMITS: Monthly rates for water

Provided, further, that for water furnished the National Guard
Armory, School District No. 25, the County Fairgrounds, and to
other governmental units, as and when directed by the City Council,
the rate charge shall be Fifteen Cents ($0.15) per one thousand
(1,000) gallons. Total chargeable consumption shall be through all
meters serving the properties of each, except if less than three
thousand (3,000) gallons is used, the minimum meter rates shall be
charged.
Section 2. That Section 3 -1-33 of Ordinance No. 78 of the City of
Chubbuck be and the same is hereby repealed. That there
.s re- enacted in lieu thereof, and in its place and stead,
and to be known as Section 3-1 -33 of Ordinance No. 78 of
the City of Chubbuck the Section that reads. as follows:

3-1-33: WATER RATES OUTSIDE CITY LIMITS: Any person adjacent to
the ity may, with the permission of the City Council,
receive water, subject to the rules and regulations as otherwise
may be provided by this Code, and subject to the discretion of
said City Council and the availability of surplus water in th-e
municipal system.
Provided, however, that the City reserves the right to shut off
such supply without notice if the supply within the corporate
limits shall become inadequate.
Rates for water furnished through meters to users outside the City
Limits shall be as follows:
For the first three thousand 03,000) gallons, Sixty Cents ($0.60)
per one thousand (1,000) gallons, plus ten per cent C1.0 %).
For the next forty -seven thousand (47,000) gallons, Fifty Cents.
0$0.50) per one thousand 01,000) gallons, plus, ten per cent (10 %).
For the next fifty thousand (50.,000) gallons, Forty Cents ($0.40)
per one thousand (1,00 -0) gallons, plus. ten per cent (10 %).
For the next fifty th.ous.and (50,000) gallons, Thirty Cents ($0.30)
per one thousand (1,000) gallons, plus ten per cent (10%).
For all water furnished over one hundred fifty thousand (150,000)
gallons, Fifteen Cents C$0.15) per one thousand (1,000) gallons,
plus ten per cent C10 %).
Provided, however, that in no case shall the rate for water fur-
nished through.each meter to a user outside the City Limits be less
than the following:

Section 3. That the purpose of this Ordinance is to bring the water
rates within the City of Chubbuck to reasonable conform-
ity. with the rates charged by other municipalities in
this area and with-the, cost of pumping, delivering, and
protecting said water and the maintenance of the munici-
pal water system.
That an emergency is hereby declared to exist and this Ordinance
shall take effect and be in full force and effect upon its passage,
approval and publication as provided by law.

OF THE CITY OF CHUBBUCK, BANNOCK COUNTY, IDAHO
REPEALING SECTIONS 3 -1 -32 AND 3- -1--33 OF ORDINANCE NO. 78 OF THE
CITY OF CHUBBUCK AND RE- ENACTING, REPLACING AND CONSTI-
TUTING IN LIEU THEREOF TWO SECTIONS TO READ AS CONTAINED
IN THE ORDINANCE HEREIN; THAT SAID SECTIONS AMEND THE
WATER RATES BOTH INSIDE THE CITY LIMITS AND OUTSIDE THE
CITY LIMITS FOR WATER FURNISHED THROUGH WATER METERS;
THE PURPOSE OF THE ORDINANCE IS TO AMEND THE WATER RATE
IN CONFORMITY WITH THE RATES CURRENTLY BEING CHARGED BY
ADJACENT MUNICIPALITIES AND AS REQUIRED FOR THE PUMPING,
DELIVERY, PRODUCTION AND MAINTENANCE OF THE MUNICIPAL
WATER SYSTEM, HAVING THE PROVISION THAT DELIVERY OF WATER
TO USERS OUTSIDE THE CITY LIMITS OF THE CITY OF CHUBBUCK
IS CONDITIONED UPON THE AVAILABILITY OF SURPLUS WATER AND
SUBJECT TO THE DISCRETION OF THE CITY COUNCIL; AND DECLAR-
ING AN EMERGENCY AND DISPENSING WITH THE READING OF SAID
ORDINANCE ON THREE SEPARATE DAYS.
