TITLE: AN ORDINANCE OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO, ANNEXING THE FOLLOWING DESCRIBED LAND, TO-WIT: Commencing at the East Quarter Corner of Section Three (3), Township Six (6) South, Range Thirty- four (31,) East of the Boise Meridian; Thence West along the Latitudinal Center Line of said Section Three (3), Twenty-five (25) feet to the Point of Beginning, which point is on the present boundary of the Village of Chubbuck; Thence East along the Latitudinal Center Line of Section Two (2), Eight Hundred (800) feet more or less to the East boundary of the Hiline Road, which point is on the present boundary of the Village of Chubbuck; Thence south- erly along the East boundary of the Hiline Road which is the present boundary of the Village of Chubbuck, Twenty-one [~ndred (2100) feet more or less to a point where the present boundary of the Village of Chubbuck bears West; Thence West along the present boundary of the Village of Chubbuck, Seven Hundred Fifty (750) feet more or less to the West boundary of the Whitaker Road, at which point the present boundary of the Village of Chubbuck bears North; Thence North along the present bound- ary of the Village of Chubbuck Two Thousand (2000) feet more or less to the Point of Beginning. ALL IN BANNOCK COUNTY, IDAHO, TO THE VILLAGE OF CHUBBUCK, AND DECLARING SAID LAND TO BE A PART OF SAID VILLAGE; t{~PEaLING ALL ORDINANCES OR PARTS OF ORDINANCES iN CONFLICT HEREWITH AND DECLARING AN ~ERGENCY. McDEVITT 8: MCDEVITT ATTORNEYS -AT- LAW ORDINANCE NO. _ ~_ WHEREAS, THE FOLLOWING DESCRIBED PARCELS OF LAND ARE CONTIGUOUS AND ADJACENT TO THE EXISTING MUNICIPAL BOUNDARIES OF THE VILLAGE OF C}~JBBUCK, BANNOCK COUNTY, IDAHO, AND WHEREAS, THE OWNERS PROPRIETORS AND PERSONS BY AND WITH THE OWNERS' AUTHORITY AND ACQUIESCENCE HAVE LAID OFF INTO LOTS OR BLOACKS, CONTAINING NOT MORE THAN FIVE (5) ACRES OF LAND EACH, AND/OR THE S~34E LAND SHALL HAVE BEEN LAID OFF, SUBDIVIDED, OR PLATTED AS SHOWN BY THE PLATS ON FILE IN THE OFFICE OF THE COUNTY RECORDER AND SURVEYOR OF THIS COUNTY, AND/OR WHEREAS, THE OWNER PROPRIETOR OR PERSONS 1 BY OR WITH HIS AUTHORITY, HAS SOLD OFF, OR BEGUN TO SELL OFF, SUCH ADJACENT OR CONTIGUOUS LANDS BY METES AND BOUNDS Ir, l TRACTS NOT ~CEEDING FIVE (5) ACRES AND WHEREAS THE FOREGOING CONDITIONS, OR SOME OF THEM, APPLY TO EACH AND EVERY TRACT AND PARCEL HEREIN- AFTER DESCRIBED, AND WHEREAS THE CHAIP~AN AND BOARD OF TRUSTEES OF THE VILLAGE OF CHUBBUCK, do at this time deem it advisable and for the best interests of the inhabitants of said Village to annex said adjacent tracts of land and parcels thereof referred to and hereinafter described and declare the same to be a part of the Village of Chubbuck, Bannock County, Idaho; NOW, THEREFORE, BE IT ORDAINED, By the Chairman and the Board of Trustees of the Village of Chubbuck, Bannock County, Idaho: Section 1. That the following described land located in Bannock--~ounty, State of Idaho, to-wit: Commencing at the East Quarter Corner of Section Three (3), Township Six (6) South, Range Thirty- four (34) East of the Boise Meridian; Thence West along the Latitudinal Center Line of said Section Three (3), Twenty-five (25) feet to the Point of Beginning, which point is on the present boundary of the Village of Chubbuck; Thence East along the Latitudinal Center Line of Section Two (2), Eight Hundred (800) feet more or less to the East boundary of the Hiline Road, which point is on the present boundary of the Village of Chubbuck; Thence south- erly along the East boundary of the Hiline Road which is the present boundary of the Village of Chubbuck, Twenty-one Hundred (2100) feet more or less to a point where the present boundary of the Village of Chubbuck bears West; Thence West along the present boundary of the Village of Chubbuck, Seven Hundred Fifty (750) feet more or less to the West boundary of the Whitaker Road, at which point the present boundary of the Village of Chubbuck bears North; Thence North along the present bound-  ry of the Village of Chubbuck Two Thousand (2000) eet more or less to the Point of Beginning. be and the same hereby is annexed to the Village of Chubbuck, Bannock County, Idaho, and declared to be a part of said Village. That it shall be the duty of the Village Clerk of the Village of Chubbuck immediately after the passage, approval, and due publication of this Ordinance according to law, to file with the County Recorder of Bannock County, Idaho, a certified copy of this Ordinance, duly and properly certified by her under the Corporate Seal of said Village, and immediately thereafter the corporate limits of said Village of Chubbuck shall extend to and include the above described tracts of land accord- ing to the description as hereinbefore set forth, and that there- after all property and persons within the limits of said annexed land shall be subject to the provisions of all the Ordinances of the said Village of Chubbuck, and to the police regulations i thereof. Section 3. That all ordinances or resolutions or parts thereof in con~ herewith be and the same are hereby expressly repealed. Section. 4- That this ordinance shall take effect from and after its passage, approval and publication, an emergency existing therefor, which emergency is hereby found and declared to exist.
