OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO,
PROVIDING FOR REGULATING THE MOVING OF BUILDINGS OR STRUCTURES
OVER PUBLIC STREETS AND THOROUGHFARES, AND THE MOVING AND
RELOCATION OF BUILDINGS AND STRUCTURES WITHIN THE VILLAGE;
PROVIDING FOR PERMITS; REQUIRING DEPOSITS FOR COSTS; RE-
QUIllING BOND OR INSURANCE PROTECTION; REQUIRING NOTICE TO
POLICE AND FIRE DEPARTMENTS AND POLICE ESCORTS; FIXING
FEES FOR POLICE ESCORTS; PROVIDING A PENALTY; AND DECLARING
AN E~iERG~CY.
BUILDING CODE
BE IT ORDAINED BY THE TRUSTEES OF THE VILLAGE OF CHUBBUCK,
BANNOCK COUNTY, IDAHO:
1. MOVING OF BUILDINGS OR STRUCTURES OVER PUBLIC STREETS OR
THOROUGHFARES:
a. No person, firm or corporation shall move any building
or structure over public streets or thoroughfares in the Village
of Chubbuck, Idaho, without first securing a permit from the
Building Department or Village Clerk, as the Board of Trustees
may designate-
b. No building or structure shall be moved or relocated
within the Village of Chubbuck, Idaho, until permission shall
be first obtained from the Board of Trustees.
c. Any person, firm or corporation desiring to secure
moving permits shall deposit with the Village Clerk a surety
bond or public liability insurance policy in the sum of Ten
Thousand Dollars ($10,000.00) made in favor of the Village of
Chubbuck, conditioned to save the Village harmless of and from
all damages, claims or causes of action which may be suffered
or which may accrue or rise by reason of the moving or removal
of such buildings or structures.
d. Such persons, firms or corporations shall before
receiving moving permits pay to the Building Inspector such an
amount as he may estimate as the cost of removing and replacing
telephone, telegraph, electric wires or other obsSructions.
Inspector's receipt for such deposits shall be produced in

order to obtain moving permit from the Building Department. The
Inspector, in turn, receipts the deposits to the Clerk.
e. Such persons, firms or corporations receiving moving
permits shall advise the Police and Fire Departments and make
arrangements in advance for police escorts and Fire Department
assistance.
f. No building or structure shall be moved over public
streets unless accompanied by at least one (1) police escort,
to be assigned by the Police Chief. Fees for such escorts
shall be at the rate of Three Dollars ($3.00) per hour for each
escort.
g. Failure to make proper reimbursements for police
escorts, Fire Department assistance or damage caused by moving
will result in denial of any further moving permits until such
reimbursements are made to parties concerned.
2. STATE PERMITS REQUIRED ON NUMBERED STATE AND FEDERAL
HIGHWAYS:
a. State of Idaho, Department of Highways moving permits
shall be produced as a condition precedent in order to obtain
Village of Chubbuck moving permits for moving of buildings or
structures over the following streets and avenues:
(1) Yellowstone Highway, also known as U.S. 91,
from the southerly Village limits to the northerly
Village limits; and,
(2) Any and all other streets or avenues within
the Village which may be designated from time to
time as State or Federal highways, or as temporary
or alternate State or Federal highways, during the
period they are so designated.
3. PENALTY:
a. Whoever violates any of the provisions of this Ordinance
shall be guilty of a misdemeanor, and upon conviction shall be
fined not to exceed Three Hundred Dollars ($300.00) or imprisoned,

not to exceed thirty (30) days, or both such fine and imprison-
ment. Each movement of a building or structure in violation of
the provisions hereof shall be deemed a separate offense.
$. ~ERGENCY DECLARED:
This Ordinance shall take effect upon and after its passage,
approval ~d publication, an emergency existing therefor.
