AN ORDINANCE OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO, ANNEXING THE FOLLOWING DESCRIBED LAND, TO-WIT: Parcel #1 Beginning at the Southwest corner of the Neider Subdivision, which point being on the Westerly boundary of the Village of Chubbuck, and is at the intersection of the Easterly right of way boundary of the Hawthorne Road and the Northerly right of way boundary of the Chubbuck Road, thence Westerly along the said Northerly right of way boundary of the Chubbuck Road to an intersection with the longitudinal center line of Section 40 Township 6 South, Range 3.4 East, Boise Meridian. Thence Northerly along said longitudinal center line to an intersection with the Southerly right of way boundary of the "Church Lateral" of the Fort Hall Irrigation Project. Thence Easterly along said right of way to the Easterly right of way boundary of the Hawthorne Road. Thence Southerly along said right of way to the point of beginning. This parcel of land contains approximately 160 acres and is situated in Sections 3 and 4.. Town- ship 6 South, Range 34 East,, Boise Meridian. Parcel #2 Beginning at the intersection of the West 1/16 line of Section 3, Township 6 South, Range 34 East, Boise Meridian, and the Northerly right of way boundary of Chubbuck Road, thence Westerly along said right of way boundary to the Southeast corner of the Neider Subdivision. Thence North- westerly along the East boundary of the Neider Subdivision to the Northeast corner of the Neider Subdivision. Thence Westerly along the North boundary of the Neider Subdivision to the Easterly right of way of the Hawthorne Road. Thence North- erly along said right of way to an intersection with the South right of way boundary of the "Church Lateral" of the Fort Hall Irrigation Project. Thence Easterly along said right of way to an intersection with the Easterly right of way boundary of the "Stuart Lateral" of the Fort Hall Irrigation Pro- ject. Thence Northerly along said right of way to an intersection with the North 1/16 line of the said Section 3. Thence Easterly along said 1/16 line to an intersection with a line parallel to and lying 321 feet West of the West 1/16 line of said Section 3. Thence Northerly on a Tine parallel with the West 1/16 line of said Section 3 to an intersection with the Southerly right of way boundary of Siphon Road. Thence Easterly along said right of way to an intersection with the West 1/16 line of said Section 3. Thence Southerly along said West 1/16 line to the point of beginning. This parcel of land contains approximately 105 acres and is situated in Section 3, Township 6 South, Range 34 East, Boise meridian. ALL IN BANNOCK COUNTY, IDAHO, TO THE VILLAGE OF CHUBBUCK, AND DECLARING SAID LAND TO BE A PART OF SAID VILLAGE; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AND DECLARING AN EMERGENCY, WHEREAS, The owners of certain tracts of land in Sections 3 and 4. Township 6 South, Range 34 East of Boise Meridian in Bahnodk County, Idaho, or persons by or with the authority of the owners, have heretofore sold or began to sell off cer- tain tracts of land by metes and bounds in tracts not exceeding five (5) acres, and whereas each and every one of said tracts, parcels, or lots of land are contiguous and adjacent to the incorporated Village of Chubbuck, Bannock County, Idaho, and whereas the Chairman and the Board of Trustees of the Village of Chubbuck do at this time deem it advisable and for the best interests of the inhabitants of said Village to annex said adjacent tracts of land referred to and hereinafter described, and declare the same to be a part of the said Village of Chubbuck, Bannock County, Idaho.. NOW, THEREFORE, in consideration of the premises, BE IT ORDAINED By the Chairman and the Board of Trustees of the Village of Chubbuck, Bannock County, Idaho: Section 1. This parcel of land contains approximately 105 acres and is situated in Section 3, Township 6 South, Range 34 East, Boise Meridian. be and the same hereby is annexed to the Village of Chubbuck, Bannock County, Idaho, and declared to be a part of said village. Section 2. That it shall be the duty of the village clerk of the Village of Chubbuck immediately after the passage, approval, and due publication of this Ordinance according to law, to file with the County Recorder of Bannock County,Idaho, a certified copy of this Ordinance, duly and properly certified by her under the corporate seal of said Village, and immediately thereafter the corporate limits of said Village of Chubbuck shall extend to and include the above described tracts of land according to the description as hereinbefore set forth, and thereafter all property and persons within the limits of said annexed lands shall be subject to the provisions of all. the ordinances of the said Village of Chubbuck, and to the police regulations thereof. Section 3. That all ordinances or resolutions or parts thereof in conflict herewith be and the same hereby are ex- pressly repealed. Section 4.
