HomeMy WebLinkAbout0045 Amending Section 9 of Ordinance 18 19591 ORDINANCE NO. � 2 3 AN ORDINANCE OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO, AMENDING SECTION 9 OF ORDINANCE NO. 18 OF THE VILLAGE OF CHUB - 4 BUCK RELATING TO THE COLLECTION OF DELINQU10T WATER ACCOUNTS AND PROVIDING FOR THE SHUTTING OFF OF THE WATER TO ANY DELIN4UhNT 5 WATER USERS; PROVIDING FOR TURNING THE HATER BACK ON UPON PAYMENT OF THE FEE; PROVIDING FOR THE INSTALLATION OF NEW AND SEPARATE 6 WATER CONNECTIONS FOR EACH BUILDING WHERE IT IS IMPOSSIBLE TO EFFECTIVELY TURN OFF THE WATER BY REASON OF CROSS - CONNECTIONS, 7 AND P ROVIDING THAT IN SUCH CASES THE REGULAR HOOKUP CHARGE PR.O- VIDED IN SECTION 12 OF ORDINANCE NO. 18 AS Alt,1ENDED SHALL BE 8 CHARGED AND COLLECTED; :RE&EALING ALL ORDINANCE; OR PA.RTS THEREOF IN CONFLICT HERE's`'`VITt AND DECLARING AN EMERGENCY. 9 10 BE IT ORDAINED BY THE CHAIRI;IAN AND THE BOARD OF TRU6TEE6 OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO :. 11 Section 1. That Section 9 of Ordinance Number 18 of the 12 Village of Chubbuck shall be and hereby is amended to read as follows: 13 Section 9. When any water rental becomes delinquent the 14 Village Clerk shall, within three days thereafter, prepare a list of all delinquent water rentals, which list shall contain the 15 name of the water user, his address, the address of the property where the water was used, and the amount of money owing and 16 delinquent. A copy of such list shall be delivered promptly to the water superintendent, and it shall be the duty of the water 17 superintendent to shut off the water from all premises shown on the delinquent list within twenty -four hours after receiving such 18 'list. The water shall not be turned back on again until the delinquent account shall have been paid in full, together with a 19 charge of 02.00 for turning the water off and on. Payment of the delinquent account, together with the charge for turning the water 20 off and on, shall be made to the Village Clerk, and the Clerk shall then give to the water superintendent a written order to 21 turn the water back on. 22 In any case where delinquency occurs in a water account, and where it is impossible to effectively turn off the water, by 23 reason of multiple connections, cross - connections, or improperly located connections of water pipes, the water superintendent steal; 24 before turning the water back on, install a separate water con - nection for such building, and shall not allow the water to be 25 turned on through any such new connection until any cross - connections, multiple connections, or any other defective con - 26 nection shall have been permanently and completely severed and disconnected from the Chubbuck water system. 27 Wherever it becomes necessary to make a separate connection 28 under the provisions above set out, and the water having been turned off for delinquent water charge, the Village Clerk shall 29 charge and collect from such water user the regular :hook -up charg provided by ordinance, in addition to the delinquent account pay - 30 ment in full, before the water shall be turned back on again and be delivered to such building. 31 Section 2. That all ordinances or parts of ordinances in 32 conflict herewith are hereby expressly repealed. •CARL C. CHRISTENSENW 1 i 1 6ection 3.
