IDAHO ORDINANCE NO., 91 ORDINANCE AMENDING ORDINANCE NUMBER 3 OF THE OFFICIAL ORDINANCES OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO, ENTITLED MAN ORDINANCE PRESCRIBING A COMPLETE TRAFFIC CODE FOR THE OPERATION OF ALL VEHICLES UPON THE PUBLIC HIGH- WAYS WITHIN THE LIMITS OF THE VILLAGE OF CHUBBUCK AND PRESCRIBING PENALTIES FOR A VIOLATION OF ANY OF THE TERMS OF SAID ORDINANCE OR OF ANY REGULATION PROMULGATED UNDER AND IN CONFORMITY WITH OR BY AUTHORITY OF SAID ORDINANCEMs BY PROVIDING RULES AND REGULATIONS RELATING TO TRAFFIC PASSING STOPPED SCHOOL BUSES WHILE LOADING OR UNLOADING CHILDREN; PRESCRIBING PENALTIES FOR A VIOLATION OF THE TERM OF SUCH RULES AND REGULATIONS; PROVIDING FOR RULES AND REGULATIONS RELATING TO THE FAILURE TO OBEY TRAFFIC CITATIONS AND PRESCRIBING PENALTIES FOR A VIOLATION OF THE TERMS THEREOF, DECLARING AN EMERGENCY. BE IT ORDIANED BY THE CHAIRMAN AND BY THE BOARD OF TRUSTEES OF THE VILLAGE OF CHUBBUCK9 BANNOCK COUNTY, IDAHO, ARTICLE I. That Ordinance Number 3 of the official ordinances of the Village of Chubbuck be amended so as to provide for the following: (1) By adding on page 6 of said ordinance and follow- ing Section 209 a Section designated as 20 (a), which will read as follows: OVERTAKING AND PASSING SCHOOL BUSES: The driver of any vehicle upon any highway, street or alley within the limits of the Village of Chubbuck, Bannock County, Idaho, upon meeting or overtakings from either direction, any school bus which has stopped on the highway9 street or alley for the purpose of re- ceiving or discharging school children9 shall stop the vehicle immediately before passing the school bus and shall remain stopped when the stop signal arm is extended. When the stop arm is not extendeds motorist mays after first stopping, pro- ceed at a speed not.exceeding ten miles per hour and with due caution for the safety of such children. IDAHO this section shall be guilty of a misdeamnor and upon conviction thereof shall be punished in accordance with Section 29 of Ordi- nance Number 3, ARTICLE II. That Ordinance Number 3 of the official ordinances of the Village of Chubbuck be amended so as to provide the follow- ings (1) By adding on page 8 of said Ordinance $hd follow- ing Section 289 a Section designated as 28 (a), which will read as followss FAILURE TO OBEY CITATIONS: (a) It shall be unlawful for any person to violate his written promise to appear given to an officer upon the issuance of a traffic citation regardless of the disposition of the char for which such citation was originally issued. (b) Failure to comply with traffic citations Attached to Parked Vehicles: If violator does not appear in response to a traffic citation affixed to such motor vehicle within a period of five (5) days the Clerk of the traffic court shall send the owner of the motor vehicle to which the traffic citation was affixed a letter informing him of the violation and warning him that in the event such letter is disregarded for a period of five (5) days a warrant of arrest will be issued. Any person violating this section shall be guilty of a misdeamnor and upon conviction thereof shall be punished in accordance with Section 29 of Ordinance Number 3. ARTICLE III. Constitutionality: If any part or parts of this ordi- fance shall be held to be unconstitutional or invalid such un- constitutionality or invalidity shall not effect the validity of the remaining parts of this act. It is hereby declared that LAW OFFICES OF CALDWELL& WHITTIER CARLSON BUILDING POCATELLO, IDAHO the remaining parts of this Ordinance would have been passed had it been known that such part or parts thereof would be de- clared unconstitutional. This Ordinance shall be in full force and effect from and after its passagep approval and due publications as pro- vided by laws► PASSED AND APPROVED this % day of Decembers 1956.
