AN ORDINANCE OF THE VILLAGE OF CHUBBUCK, BANNOCK COUNTY, IDAHO, REQUIRING A
LICENSE FOP. ALL DOGS; PRESCRIBING LICENSE FEES; PROVIDING T114- T ALL DOGS SHALL
BE TAGGED; PROVIDING THAT DOGS NOT LICENSED OR TAGGED, ARE DECLARED TO BE A
NUISANCE; PROVIDING FEES FOR OBTAINING DOGS IMPOUNDED; PROVIDING FOR THE COL-
LECTION OF THE FEES PRESCRIBED HEREIN; DECLARING AN EMERGENCY; AND REPEALING
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREV+]ITH:
BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE VILLAGE OF CHUBBUCK, BANNOCK
COUNTY, IDAHO:
SECTION 1. It shall be unlawful for any person to own or harbor any dog,
bitch or pup over two (2) months of age, within the incorporated limits of the
Village of Chubbuck, without having first obtained a license therefor, as herein
provided.
SECTION 2. There is hereby levied a license fee upon each dog over the age
of two (2) months, owned or kept within the limits of the Village of Chubbuck as
follows:
For every male dog over the age of two (2) months, the sum of $3.00
per year, or fraction thereof; and for every female dog over the age of two (2)
months, which has been spayed, #e "sum of $3.00 per year, or fraction thereof;
and for every female dog over the age of two (2) months and not spaired, the sum
of $5.00 per year, or fraction thereof; provided further that when a person pur-
chases a license for a spayed female dog, such person shall be required to pre-
sent an Affidavit from a registered and qualified Veterinarian that such female
dog has been spayed.
SECTION 3, Every owner or harborer of any dog or bitch or pup over the age
of six (6) months, within the incorporated limits of the Village of Chubbuck, is
hereby required to secure about the neck of such animal, a suitable collar with
a license tag attached thereto, to be procured from the Village Clerk.
SECTION 4. Any dog or bitch or pup more than six (6) months of age found
running at large within the Village of Chubbuck, at any time of the year, without
a license obtained or which is not tagged, as required by this Ordinance, is here-
by declared to be a nuisance, and it shall be the duty of the Chief of Police to
place such animal in a pound to be provided by him for that purpose, and kept
there for a period of two (2) days, and if no person shall claim the same, the
Chief of Police may offer the same for sale at public auction, without notice,
and if no bid in the amount of $2.00 or more is received therefor, it shall be the
duty of the Chief of Police to cause said animal to be killed.
SECTION 5. Any person applying to the Chief of Police for any dog that may
have been impounded, shall, before receiving the—same, pay to the Chief of Police
for the Village of Chubbuck, the sum of $1.00 per day for each day said dog has
been impounded, and shall, in addition, pay the license fees provided herein, be-
fore such dog shall be released.
SECTION 6. The Chief of Police shall turn over all fees collected under the
terms of this Ordinance, to the Village Treasurer, with an itemized statement
showing the amount of each fee collected,_the date of collection, and the person
by whom the same was paid.
SECTION 74 ;That an emergency is hereby declared to exist, and this Ordinance
shall be in full force and effect immediatel -,T upon its passage and approval and
publication, as provided by law.
SECTION 8. All Ordinances or parts of Ordinances in conflict herewith are
hereby repealed.
