0588 Land Use Districts 2004CITY OF CHUBBUCK, IDAHO ORDINANCE NO. AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, CLARIFYING THE INTERESTS OF A LIMITED COMMERCIAL (C-1) ZONING CLASSIFICATION; AMENDING THE SCHEDULE OF GENERAL CONTROLS FOR LAND USE DISTRICTS IN LIMITED COMMERCIAL (C-1) DISTRICTS; AMENDING SECTION 18.12.020(C) OF THE CHUBBUCK MUNICIPAL CODE TO LESSEN THE REQUIRED BUFFER TO A RESIDENTIAL LOT WHERE THE NONRESIDENTIAL USE IS A PERMITTED USE IN A LIMITED COMMERCIAL (C-1) ZONE; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 18.12 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. The definition of a limited commercial (C-1) district is modified as follows: 18.08.010 Enumeration of Districts: The following land use districts are hereby established: F. Section 3. Section 18.12.020(C) of the Chubbuck Municipal Code is amended as follows: C. Side and Rear Yard Requirements for Nonresidential Uses Abutting Residential Districts. -I- Nonresidential structures or uses shall not be located nor conducted closer than forty feet (40') to any lot line of a residential district, except fie; W Ordinance -Paappss 7 C1024.0M The minimum yard requirements may reduced to fifty percent (50%) of the requirement if acceptable landscaping or screening or combination thereof is provided. Such screening shall be a solid fence a minimum of six feet (6) in height maintained in good condition and free of all advertising or other signs. is Landscaping provided in lieu of or in addition to such wall or fence shall be properly maintained and shall, at a minimum, consist of a strip of land not less than twenty feet (20') in width planted with an evergreen hedge or dense planting of evergreen shrubs not less than four feet (4') in height at the time of planting. K ADMINISTRATIVE PROVISIONS Section 1. Reveal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapters 18.08 and 18.12 not herein amended shall remain in full force and effect. Section 2. So&a&ility. If any provision of this Ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any remaining provisions. Section 3 Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
