HomeMy WebLinkAbout0589 Major Home Occupation 2004CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 5 R 9 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 18.12.030 (2)(k) OF THE CHUBBUCK MUNICIPAL CODE TO CLARIFY THAT A DAY CARE MAY BE A MAJOR HOME OCCUPATION FOR WHICH THE PROCEDURES FOR A MAJOR HOME OCCUPATION MAY APPLY; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING TI -IAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 18.12 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Intent. A Daycare that does not involve outside employees can be handled by city staff in an efficient manner as a major home occupation. With a major home occupation, the applicant can avoid conditional use hearing procedures if all of the neighbors within three hundred feet sign off on applicant's application. If they do not, then a conditional use permit would be needed. This ordinance clarifies that'a daycare is appropriate for consideration as a major home occupation. Section 2. Amendment. Section 18.12.030 (2) (k) is amended as follows: k. Permitted major home occupations, provided the above. regulations are met, shall include, but are not necessarily limited to, the following: (i) Any use allowed as a minor home occupation; (ii) Single -chair beauty parlors and barbershops; (iii) Photo developing and photo studios; (iv) Organized classes with up to six (6) students at one time; (v) Television and other electrical repairs excluding major appliances such as refrigerators or storage; (vi) Small engine repairs, excluding major automobiles, motorcycles and snowmobiles; (vii) Upholstering; (viii) Dressmaking; (ix) Woodworking excluding cabinetmaking; =d (x) Trained massage therapists; and (xi) Daycare. Ordinance - Pae t chubbuck05.03b ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 18.12 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
