HomeMy WebLinkAbout004.09.19 City of Chubbuck Land Use and Development Commission Meeting Minutes April 9, 2019-7:00 pm Minutes of the Land Use and Development Commission regular meeting held at Chubbuck City Hall, 5160 Yellowstone, on April 9, 2019. Chair Jason Mendenhall: Commission Members: Mike Schwartz, Dan Stoddard, Rebecca Berls, Brady Smith, Brandon Jackson, Carrie Holm, and TJ Budge. Community Planning and Economic Development Director: Devin Hillam, Senior Planner: Don Matson, City Planner: Paul Andrus, City Attorney:Tom Holmes, Office Administrator: Ranelle Simmons Mendenhall called the meeting to order at 7:00 pm asking Stoddard to lead the commission in the Pledge of Allegiance. Mendenhall asked if any commissioners had a conflict of interest within the items before the board tonight. Berls was contacted by a neighbor regarding Public Hearing item #1. Smith does have a conflict with Public Hearing item #2 and General Business item #1. APPROVAL OF THE MINUTES: March 14, 2019 Mendenhall entertained a motion to approve the minutes as emailed. Schwartz moved the minutes of March 14, 2019 meeting be approved as emailed; Stoddard seconded. The full authority approved. PUBLIC HEARING 1. An application for a change in Land Use District from Limited Residential (R-2)to Limited Commercial (C-1) on approximately 2.75 acres of land. Subject property in the SE 1/4 of Section 4,Township 6 South, Range 34 East of the Boise Meridian, Idaho, generally located at 820 W Chubbuck Road, Chubbuck, Idaho. The Comprehensive Plan Future Land Use map designates this area as Mixed Use. Type of Action: Recommendation to City Council. (Action Item) Jared Pugmire High Desert Physical Therapy 3000 Williams Street Pocatello, ID 83201 is the applicant. The church will be a physical therapy clinic with an art school. Outside areas and trees will be cleaned. Pugmire explained how the interior will be used. Hours will be 8:00 am to 6:00 pm. Monday thru Friday, no week-ends. Free workshops may be scheduled in the evening to educate the public. Emily Pugmire 3000 Williams Street Pocatello, ID 83201 will be the art teacher. Is not teaching yet but not looking at more than 8-10 students at one time for hour classes. Employee max will be 15. Two entrances off of Chubbuck Road is where clients will enter. City staff Matson,the applicant is asking to change zoning to limited commercial C-1. Most uses in limited commercial are conditional. There is quite a bit of movement options and access wasn't an issue when it was a church. The applicant owns the property out to the street in the back. Mendenhall opened the public hearing. John Boyle 4891 Cole, Chubbuck lives behind the old church. No problems with the business, access or traffic. Excited it's being used. Jaqueline Nelson 4626 Ponderosa Street, Chubbuck. The Pugmires will make great improvements. Excited they are coming to Chubbuck. John Bryant 831 Todd, Chubbuck owns 10 feet of the property at the back of the building. It is asphalt all the way to Todd. He agrees that it is good to have the property being used. He is willing to meet with the new owners. Dallen Vesser 851 Todd, Chubbuck is concerned with kids playing on Todd. Symoni Bryant 831 Todd, Chubbuck agrees with the kids' issue. Love to see the building improved. Amanda Christian owns 750 W. Chubbuck Road, Chubbuck is concerned that there needs to be a traffic signal because of the busy traffic and the bus stop. Property value is also a concern. Denise Watson 4643 Ponderosa, Chubbuck is opposed to the traffic. Boyd Byrd 5036 Kevin, Chubbuck is concerned with the access to Todd and the traffic. Mendenhall closed the public hearing bringing the meeting back to the commission. Applicant,Jared Pugmire, came forward for questions from the commissioners. He explained they are not planning on using the Todd access. Not opposed with putting up a sign or gate as long as there is an agreement that he is not liable for kids playing in the area. Mendenhall entertained a motion. This is a recommendation to City Council. Budge moved to recommend that City Council approve the rezone application with the condition that a traffic control device be installed at the access to Todd to advise users that this is an emergency access only. Berls seconded. With all commission members understanding the motion they voted. An application for a change in Land Use District from Agriculture (A)to Single Family Residential (R-1) on approximately 1 acre of land. Location is in the West'of the NE1/4 of the SW'A Section 2,Township 6 South, Range 34 East of the Boise Meridian, Idaho, generally located at the NW corner of Tree Valley Road and Garden Drive in Chubbuck, Idaho. The Comprehensive Plan Future Land Use map designates this area as Low Density. Type of Action: Recommendation to City Council. (Action Item) J:\Planning\LUDC\LAND USE SECRETARY\Minutes\Minutes 2019\004.09.19.docx 2 Bryan Moon 826 McKay Street Chubbuck, ID 83202 is the applicant and owner of Rocky Mountain Construction.The 2 acre property was bought to develop.The south half is in R-1 zone,the north is in A zone. Commissioners had no questions for the applicant. Matson stated the parcel needs to be one zone. Mendenhall opened the public hearing. Brent Carlson 1135 Buffalo Road, Pocatello. Are there plans to divide the lot? Is there a plan to push Garden Drive thru? Mendenhall closed the public hearing bringing the meeting back to the commission. Mendenhall entertained a motion. This is a recommendation to City Council. Jackson moved to recommend approval of item #2 to City Council for approval. Holm seconded. With all commission members understanding the motion they voted. An application for a preliminary plat for Moon Valley Subdivision. Applicant proposes to subdivide 1.95 acres into 2 residential lots. Property is in the West.% of the NEY4 of the SWY4 Section 2,Township 6 South, Range 34 East of the Boise Meridian, Idaho, generally located west of Tree Valley Road at Garden Drive in Chubbuck, Idaho. Current zoning designation is Single Family Residential (R-1) on the south half. The north half is in the Agriculture (A) zone and is under application for a change to Single Family Residential (R-1) as well. Application will be evaluated against criteria established for preliminary plats in section 17.12.100 of municipal code. Type of action: Recommendation to City Council. (Action Item) Brian Moon 826 McKay Street Chubbuck, ID 83202. Master Plan of the City of Chubbuck shows Garden Drive will go thru to Hiline Road at some point. The right-of-way has been granted to the city for future use. No other splits on this property,two single family homes with a shop will be built. Driveways and front of homes will face Tree Valley Road.The flood zone will not have a home built on it. North of Garden Drive on Tree Valley is gravel. Matson informed commissioners that the Garden Drive right-of-way will be dedicated to the city for future use. On the plat it states the street will be constructed by the city at a future date. Property between the homes will be left natural like it is now. The floodplain is addressed on the plat and sewer utilities are correct on the map. Mendenhall mentioned this is conditioned upon the rezone change. Carlson was invited back to the podium. Path should be maintained for walkers. Flooding across the plane has happened 3 to 4 times in J:\Planning\LUDC\LAND USE SECRETARY\Minutes\Minutes 2019\004.09.19.docx 3 the last 12 years. Mendenhall entertained a motion. Schwartz moved after reviewing the application and the staff report, hearing the testimony by city staff recommending to City Council to approve the application for the preliminary plat on the condition that the zoning change be approved. Stoddard seconded. With all commission members understanding the motion they voted. Mori Byington from Bannock Transportation Planning Organization to discuss existing and future conditions and land uses as they pertain to the draft Metropolitan Transportation plan 2045. Byington was present to talk about the future. Also discussed in part balanced growth scenarios map, development status map, place type map, and taking input from the commissioners. Hillam went over his comments on the development status map and place type map. Byington closed with discussion on the community forecast residential and commercial growth maps. Hillam asked the commission to review the maps and send to him. Mendenhall informed the commissioners that this is the last meeting Nelli will be the secretary for Land Use. Wishing her a great retirement. Mendenhall entertained a motion to adjourn; Schwartz made the motion. Berls seconded.
