APPLICATION FOR A ZONE CHANGE - STAFF REPORT
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON MAY 14, 2019
STAFF FINDINGS SUMMARIZED
After review the application, Staff finds that it likely meets the requirements for the Change in Land Use
District.
The Comprehensive Plan Future Land Use map designates this area for “Mixed Use” and
Medium Density” land uses and development, which is supported by the Limited Residential
R-2) zoning district.
All but one of the neighboring parcels to the north, east and south are in the R-2 zone.
FACTS
REQUEST: The applicant requests a Change in Land Use District for approximately 4.2 acres from the
Industrial (I) zone to the Limited Residential (R-2) zone on two parcels. Most of the larger parcel, which
has frontage on Whitaker Road, is already in the R-2 zone and comprises over 8.6 acres. The smaller
parcel, touching Chubbuck Road, is all in the Industrial (I) zone and covers about .7 acres.
Background
An application for a Planned Unit Development (PUD) that included these two parcels was denied by the
City Council on February 6, 2019. The original PUD application included duplexes/twin homes and
apartments (more than 4 units per building). Single family and duplex/twin homes are permitted in the R-
2 zone but apartments are not allowed.
TYPE OF COMMISSION ACTION: Quasi-Judicial (Subject to appeal; decisions must be supported by the
evidence and by applying law to the facts; decisions shall be based on the standards for approval).
The Commission may recommend approval with or without conditions, may table a decision, or may
recommend denial of the application.
