COUNCIL MEET1NG MINUTES
November 14th, 2000
Minutes of a regular meeting held at the Chubbuck City Council Chambers, November 14th,
2000.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Keams, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor Cotant.
iNVOCATION was given by Bishop Clark Anderson, Chubbuck 1st Ward, Chubbuck Stake, The
Church of Jesus Christ of Latter-Day Saints.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Cade Hollingsworth.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to Regular
Meeting Minutes of October 24th, 2000.
Councilman Kearns moved to approve the regular meeting minutes of October 24th, 2000
as read, Councilman Gunter seconded. All council members voted in favor of motion.
BEER
AND WINE'LICENSE APPLICATION - Wal-Mart Super Center #1995, 4240
Yellowstone Ave. has applied for a license to sell beer and wine at 4240 Yellowstone
Ave.
Councilman Keams moved to grant a beer and wine license to Wal-Mart Super Center,
4240 Yellowstone Ave, Councilman Quick seconded. All council members voted in favor
of motion.
DAY CARE FACILITY LICENSE APPLICATION - JoLynn Thomas, 4648 Targhee Place,
Chubbuck, Idaho has applied for a day care facility license to operate a day care at 4648
Targhee Place, Chubbuck.
All departments recommended approval of the license.
Councilman England moved to grant a day care facility license to JoLynn Thomas, 4648
Targhee to operate a day care facility at 4648 Targhee, Councilman Kearns seconded. All
council members voted in favor of motion.

DAY CARE FACILITY LICENSE APPLICATION - Mindy Bennett, 38s900w, Blackfoot, Idaho
has applied for a day care facility license to operate a day care facility at 749 Bonanza,
Chubbuck, Idaho.
All departments recommended approval of the license.
Councilman Kearns moved to grant a day care facility license to Mindy Bennett to
operate a day care facility at 749 Bonanza in Chubbuck, Councilman Gunter seconded.
All council members voted in favor of motion.
BUSINESS LICENSE APPLICATION - Lawrence D. Jenkins, Jenkins and Son, 1014 Elmira
Road, Sandpoint, Idaho has applied for a business license to sell Christmas trees from the
Green Triangle Parking Lot at 4010 Yellowstone Ave.
Councilman England moved to grant a business license to Lawrence D. Jenkins, Jenkins
and Son to sell Christmas trees from the Green Triangle Parking Lot at 4010 Yellowstone
Ave, Councilman Kearns seconded. All council members voted in favor of the motion.
LETTER OF REQUEST TO US ARMY CORPS OF ENGINEERS FOR STUDY AND
PLANNING WORK - PWD Smart said he talked to Terry Bailey, Bannock County
regarding concerns the Council has about the Letter of Request from the Corps of
Engineers. Mr. Bailey said that neither Bannock County, nor the City of Pocatello have a
particular project in mind. The letter of interest does not obligate any of the governments.
It is only intended as an expression of interest in participating in the Corps of Engineers
programs.
PWD Smart said the City of Pocatello is expecting to need to spend about 6.5 million
dollars in the near future on storm water management issues. They feel that, if they are
going to invest that money anyway, they may as well get the participation of the Corps of
Engineers and federal grant money. Pocatello is willing to put up some of the money they
already anticipate spending as a match for any study grant they may receive.
If the Council decides to sign the letter they would be given the opportunity to opt in to or
out of any program or proposal made, giving the City of Chubbuck full control over
whether or not we would expend money. All three agencies have the same attitude, which
is that they don't want to sign a blank check. Basically, this is a letter expressing interest
to the Corps of Engineers simply to enable access to some of the funding they might
have. PWD Smart recommended the City participate with the other agencies in seeking
this funding.

Councilman Keams made motion Mayor Cotant and Council will participate with the
other agencies in seeking this funding, Councilman Quick seconded. All council
members voted in favor of the motion.
CLAIMS - Computer print-out claims presented to Mayor Cotant and Council.
Councilman Gunter moved to approve computer print-out claims as presented,
Councilman England seconded. All council members voted in favor of motion.
GENERAL DISCUSSION -
1. Water line on Siphon Road.
2. Possible location of a proposed skate board facility

Richard Marley, 5150 Stuart suggested Mayor Cotant and Council write to the Idaho
Public Utilities Commission in opposition to the proposed 30% natural gas price hike.
Mr. Marley stated his concern is residents will start using their wood fire places
because of the higher costs, causing pollution concerns. Mayor Cotant stated he has a
letter ready to go to the ICUP and will add these concerns. The Council agreed to sign
the letter.
Public Works Director Smart reminded Mayor Cotant and Council there is an open
invitation to meetings on the Economic Impact of Ground Water Protection. November
16th and 17th, 2000 from 8:00 a.m. to 12:00 p.m. at the City of Pocatello Council
Chambers.
PWD Smart raised the issue the City is going to have to be more active or responsive
about storm water connections to the Fort Hall Irrigation Canal. PWD Smart said the
time is close when the City will be required to treat the storm water before it enters
the Fort Hall Main Canal.
Councilman Quick stated the State of Idaho has been targeted, either by legislation, or
by initiative to legalize medical marijuana and the production of commercial hemp.
Councilman Quick said there will be facts and more information against the proposals
that will be presented at a later date.
