HomeMy WebLinkAbout06 13 2000 CM83 COUNCIL MEETING MINUTES June 13th, 2000 Minutes of a regular meeting held at the Chubbuck City Council Chambers, June 13th, 2000. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. smart and City Clerk Ron C. Conlin. Councilman Steven M. England was excused. Meeting was called to order at 7:30 p.m. by Mayor Cotant. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the regular meeting minutes of May 24th, 2000. Councilman Kearns moved to approve the regular council meeting minutes of May 24th, 2000 as read, Councilman Quick seconded. All council members present voted in favor of motion. J. R. SIMPLOT COMPANY - Rick Phillips, J. R. Simplot Co. was present to donate $1,100.00 to the City of Chubbuck War Memorial. Mayor Cotant and Council thanked the J.R. Simplot Company. BUSINESS LICENSE APPLICATION - Randy J. Watson, Overton, Nevada, Inland Empire Shows, Inc. has applied for a business license to operate a carnival at the Pine Ridge Mall Parking Lot. Councilman Gunter moved to grant a business license to Randy J. Watson, Overton, Nevada, Inland Empire Shows, Inc. to operate a carnival at the Pine Ridge Mall Parking Lot, Councilman Kearns seconded. All council members present voted in favor of the motion. FIREWORKS PERMIT APPLICATIONS - The following applicants have applied to sell fireworks from fireworks stands at the following locations: 1. Bruce Weaver, Twin Falls, Idaho to locate at 4752 Yellowstone Ave. (Rite Aid Parking Lot). 2. Randy Broadhead, 1631 Von Elm, Pocatello, Idaho to locate at 134 W. Chubbuck Road. 85 COUNCIL MEETING MINUTES - (cont.) June 13th, 2000 FIREWORKS PERMIT APPLICATIONS - (cont.) 3. American Promotional Events, 4894 S. 300 West, Murray, Utah to locate at the Wal- Mart Parking Lot and at 4845 Yellowstone Ave. (Smith's Food King Parking Lot). 4. Veronique Abdalla, 240 Fairmont, Pocatello, Idaho to locate at the Pine Ridge Mall Parking Lot. 5. Shari Kress, 5110 Dorian, Chubbuck to locate at 4825 Yellowstone Ave. (Behind Papa Murphy's Pizza). Fire Chief Eric King has reviewed all applications, FC King stated the Fire Department is not going to allow the fireworks stand at Wal-Mart Parking Lot due to the construction of the Wal-Mart Building, the parking facilities are not adequate. FC King said he talked to the people that applied for the fireworks permit, they are checking with Pine Ridge Mall, trying to get a location at the Mall. FC King stated the only way the fireworks stand will be allowed at the Wal-Mart Parking Lot is if Wal-Mart removes all their garden sales and supplies from the parking lot. When the stands are in place the Fire Department will inspect. Councilman Gunter moved to approve the fireworks permit applications as presented subject to; (a) Fire Department inspecting fireworks stands prior to their opening, b) all applicants are required to follow Chubbuck Fireworks Code. c) Building Department to approve where stands are located, d) if the applicant applying for the Wal-Mart Parking Lot location can get the approval from Price Development to locate their fireworks stand at Pine Ridge Mall Parking Lot, they can, Councilman Quick seconded. All council members present voted in favor of motion. BID RESULTS FOR WEST CHUBBUCK ROAD CONSTRUCTION PROJECT - Rodney Burch, Rocky Mountain Engineering presented the following bids the City of Chubbuck received: Bannock Paving $ 323,198.55 Frasure Construction $ 468,000.00 Rodney Burch recommended the City accept the Bannock Paving Bid of $323,198.55. Councilman Quick moved to authorize Mayor Cotant to enter into agreement with Bannock Paving for the West Chubbuck Road Construction Project in the amount of $323,198.55, Councilman Kearns seconded. All council members present voted in favor of motion. COUNCIL MEETING MINUTES - (cont.) June 13th, 2000 87 ORDINANCE - Amending Section 5.07.140 to require a driver's license instead of a chauffeur's license; amending Section 6.04.060 to provide for annual licenses for daycare facilities' adding Section 6.04.095 to require all children in a daycare facility to have current immunizations; amending 6.04.120 to specify certain conditions applicable to daycare facilities. Attorney Holmes read ordinance by title only for the first reading. ORDINANCE - Amending Chapter 9.20.021 to provide dog and kennel licenses are on a calendar year term; eliminating the provision doubling fees if not purchased by a certain date; amending Section 9.20.023 to place the responsibility for licensing under Chapter 9.20 with the Chief of Police. Attorney Holmes read ordinance by title only for the first reading. ORDINANCE - Amending Section 15.24.020(B) of the Chubbuck Municipal Code to allow reader board signs. Attorney Holmes read ordinance in full for the second reading. ASSOCIATION OF IDAHO CITIES CONFERENCE IS IN COEUR D' ALENE - JUNE 26TM THROUGH THE 30TM OF JUNE, 2000 - Mayor Cotant and Council was in agreement the regular meeting on June 27th, 2000 will be cancelled. CITY OF CHUBBUCK EMPLOYEE SAFETY AND HEALTH POLICY - Mayor Cotant and Council reviewed the Safety and Health Policy for City Employees. Councilman Kearns moved to adopt the City of Chubbuck Safety and Health Policy, 2000 as read, Councilman Quick seconded. All council members present voted in favor of motion. PROCLAMATION - "ARMY WEEK" JUNE 12TH-18TH, 2000 - Mayor Cotant read proclamation in full. Councilman Gunter moved to direct Mayor Cotant to proclaim the week of June 12th through June 18th, 2000 as "Army Week", Councilman Quick seconded. All council members present voted in favor of motion. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Quick moved to approve the computer print-out claims as presented, Councilman Gunter seconded. All council members voted in favor of motion. 89 COUNCIL MEETING MINUTES - (cont.) June 13th, 2000 FINANCIAL REPORT for the month of May, 2000 presented to Mayor Cotant and Council. GENERAL DISCUSSION - 1. PWD Smart reported East Chubbuck Road bids were opened today in Boise. Bannock Paving was the only bid received. Bannock Paving bid is $1,946,000. At 7:55 p.m., Councilman Gunter moved, Councilman Kearns seconded, with full council approval to adjourn meeting. Ron C.
