HomeMy WebLinkAbout05 24 2000 CM77 COUNCIL MEETING MINUTES May 24th, 2000 Minutes of a regular meeting held at the Chubbuck City Council Chambers, May 24t~, 2000. This regular meeting was scheduled today because of an election in the Council Chambers on May 23rd, 2000. Present: President of Council Steven M. England, Council members Leroy S. Quick, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and Ron C. Conlin. Mayor John O. Cotant was excused. Meeting was called to order at 7:38 p.m. by President of Council Steven M. England. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the regular meeting minutes of May 9th, 2000. Councilman Kearns moved to approve regular council meeting minutes of May 9th, 2000 as read, Councilman Gunter seconded. All council members voted in favor of motion. BUSINESS LICENSE APPLICATION- Jackie M. Foulger, 4938 Elizabeth, Chubbuck, Idaho has applied for a business license to sell ice cream from a truck. Councilman Kearns moved to grant Jackie M. Foulger a business license to sell ice cream from a truck in the City, Councilman Gunter seconded. All council members voted in favor of motion. GARDEN OAKS PRELIMINARY PLAT - An application by Working Performance Co. 697 E. 1600 N., Idaho Falls, Idaho for a preliminary plat for Garden Oaks Subdivision. Property is presently zoned Limited Residential, ((R-2).This agenda item was tabled from the April 25th, 2000. PWD Smart stated all the items of concern that were left off the preliminary plat presented at the April 25th, 2000 Council meeting have been added. PWD Smart stated the Garden Oaks Final Plat has also been prepared, and is on this Council Agenda. Bill Konzel, 5375 Stuart Ave. express several concerns he has, if Council approves the Garden Oakes Preliminary Plat. Bill Konzel is opposed to the Garden Oakes Preliminary Plat approval. Some of concerns he spoke on: 1. Protecting current home owners market value. 2. Felt Council is rushing to make a decision on the Garden Oaks Subdivision. 79 COUNCIL MEETING MINUTES - (cont.) May 24th, 2000 GARDEN OAKS PRELIMINARY PLAT - (cont.) 3. Did not feel the City Council is following City Ordinances. 4. Asked Council to require Proposed Covenant Changes - (attached). Mr. Konzel was told City does not enforce Restrictive Covenants. 5. Ownership requirements - Final Plat proposed is owned by Willard Price. 6. Telephone or gas utilities are not shown on plat. 7. Felt the City is acting as an attorney for Willard Price. 8. Residents cannot enforce restrictive covenants if they are not in the subdivision. Chad Holman, 5267 Stuart expressed concern about decrease in the value of his property if the Garden Park Preliminary Plat is approved. Mr. Holman spoke against approval of the preliminary plat. Darren Bauer, 5270 Stuart spoke against approval of the Garden Oaks Preliminary Plat. Mr. Bauer expressed concern about his property values decreasing. Neil Matthewson, 422 Mindy Drive asked if there is an easement for a bridge crossing at the canal. Councilman England stated the City has received a copy of a letter from Fort Hall Irrigation to the developer that takes care of the concern. Discussion about when and where the City Park will be located. Attorney Holmes explained the City's policy on park dedication. Phil Quinton, 5372 Lori Lane spoke against the approval of the Garden Park Subdivision Preliminary Plat. Mr. Quinton expressed concern about his property values decreasing. Hugh Hatch, Siphon Road expressed concern of too many regulations. Discussion about zero lot lines. Mr. Price said he understands that if they are not on the plat now, there can be no zero lot lines in the future. Mark Salcedo, 465 Mindy asked if the streets will go all the way from Siphon to the current Cottage Grove Subdivision now. Mr. Salcedo was told the streets will be finished in phases. Discussion about park dedication for the Cottage Grove Subdivision. A neighborhood park is planned for the Garden Oaks Subdivision. Gary Sontag, 425 Mindy stated he felt there could be other solutions that would help Cottage Grove Subdivision residents concerns. 81 COUNCIL MEETING MINUTES - (cont.) May 24th, 2000 GARDEN OAKS SUBDIVISION PRELIMINARY PLAT - (cont.) Councilman England stated Willard Price has met the required criteria for approval of the Garden Oaks Subdivision Preliminary Plat. Councilman Gunter moved to approve the Garden Oaks Subdivision Preliminary Plat as presented, Councilman Kearns seconded. All council members voted in favor of motion. GARDEN OAKS FINAL PLAT - PWD Smart stated all construction drawings and requirements have be completed. Councilman Kearns moved to approve the Garden Oaks Final Plat as presented, subject to City Engineering Department approval, Councilman Gunter seconded. All council members voted in favor of motion. ORDINANCE - Amending Section 15.24.020(b) of the Chubbuck Municipal Code to allow reader board signs. Attorney Holmes read ordinance by title for the first reading. Council tabled the ordinance until the June 13th, 2000 Council Meeting. GENERAL DIS CUS SION - 1. Cities-County Meeting, May 26th, 2000, Friday at noon at the City of Pocatello Council Chambers. 2. Councilman Kearns suggested the City Council look at the ordinance dealing with preliminary platting. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Quick moved to approve computer print-out claims as presented, Councilman Kearns seconded. All council rr)¢mbers voted in favor of motion.
