HomeMy WebLinkAbout01 25 2000 CM17 COUNCIL MEETING MINUTES January 25th, 2000 Minutes of a regular meeting held at the Chubbuck City Council Chambers, January 25th, 2000. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor Cotant. PLEDGE ALLEGIANCE TO THE FLAG was lead by Tanner Mitton. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to Special Meeting Minutes of January 11th, 2000 and Regular Meeting Minutes of January 11th, 2000. Councilman Keams moved to approve Special Meeting Minutes of January 1 lth, 2000 and Regular Meeting Minutes of January 1 lth, 2000 as read, subject to typos and spelling errors being corrected, Councilman Gunter seconded. All council members present voted in favor of motion. ORDINANCE #522 - Adding Chapter 15.52 to the Chubbuck Municipal Code to adopt NFPA 230 (1999 Edition), fire protection of storage, authorizing the Fire Chief or the Chief's designee to implement and enforce NFPA 230; providing existing uses have two years from the effective date of this ordinance to implement any necessary structural or infrastructure changes; providing that existing uses shall be in compliance with all other provisions of NFPA 230 by March 1, 2000, unless granted an extension. Attorney Holmes read Ordinance #522 by title for the third reading, one of which was in full. Councilman Quick moved to adopt Ordinance//522 as read, Councilman Kearns seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. PROPOSED LOCAL IMPROVEMENT DISTRICT #2 - Nick Crookston was present, stating he would like to see the Local Improvement District #2 dropped. Mr. Crookston said he talked to Charlie Frasure, Mr. Frasure said he talked to Gary Ratliff and was told he is waiting for his engineer. PWD Smart stated the construction drawings for Gary Ratliff's Project have been approved. 19 COUNCIL MEETING MINUTES - (cont.) January 25th, 2000 PROPOSED LOCAL IMPROVEMENT DISTRICT #2 - Councilman Kearns moved to table the proposed Local Improvement District #2 until the second Council Meeting in April, 2000, Cotmcilman Quick seconded. All council members voted in favor of motion. ORDINANCE - Amending Section 12.04.040 to require a permittee under Chapter 12.04 to have General Public Liability Insurance of not less than one million dollars, (1,000,000.); to name the City as an additional insured; requiring notice of cancellation be provided by the insurance company to the City; amending Section 12.04.060 to allow the permit fee to be set by Resolution of the City Council. Attorney Holmes read ordinance by title only for the first reading. PWD Smart was directed to compare other City's in the State with our rate, then present to Council at next City Council Meeting. Council tabled the ordinance until February gth, 2000 Council Meeting. DISCUSSION ABOUT PARK DEDICATION FEE FOR VISTA PARK SUBDIVISION - Mike Bunce explained what he thought was said at the Vista Park Subdivision Preliminary Plat Public Hearing. Mr. Bunce felt Harold Scalf dedicated the land for a park. PWD Smart stated the City does not have any record of a plat showing dedication of park land from Harold Scalf. Mike Bunce suggested the City pay the $30,000., Harold Scalfis asking for the park property. Attorney Holmes explained the cash in lieu of park dedication fee, and how it came about. Councilman Keams suggested the cash in lieu of park dedication fee be reviewed, and increased. GENERAL DISCUSSION: 1. City Staff Meetings have been changed from Tuesdays to Wednesdays, at 9:30 a.m. 2. Discussion about East Bench Upper Pressure Zone Master Plan - Will discuss at next City Council Meeting. 21 COUNCIL MEETING MINUTES - (com.) January 25th, 2000 QUARTERLY REPORT ending December 31st, 1999 was presented to Mayor Cotant and Council. CLAIMS - Computer prim-out claims presented to Mayor Cotant and Council. Councilman Kearns moved to approve computer print-out claims as presented, Councilman England seconded. All council members voted in favor of motion.
