HomeMy WebLinkAbout0788 Ratliff Subdivision Vacate21904996 CITY OF CHUBBUCK, IDAHO ORDINANCE NO. -r6 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, TO VACATE THE CUL DE SAC AND ASSOCIATED UTILITY EASEMENT IN LOT 5 OF RATLIFF SUBDIVISION DIVISION NO. l; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. History. Lot 5 of Ratliff Subdivision, Division No. 1 includes a cul de sac and associated utility right of way that the Owner has determined is no longer necessary and will be replaced by a hammerhead in the proposed Intermountain Subdivision, a replat of Lots 3, 4 and a portion of Lot 5 of Ratliff Subdivision Division 1. Section 2. Vacation. The cul de sac and associated utility easement that is in Lot 5 of Ratliff Subdivision Division No. 1, the legal description of which is more particularly described on the attached Exhibit is hereby vacated. Section 3. Recording. The Chubbuck City Clerk is hereby directed to cause the ordinance to be recorded in the records of Bannock County. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date.
