HomeMy WebLinkAbout11 25 2003 CM201 COUNCIL MEETING MINUTES November 25th, 2003 Minutes of a regular meeting held at Chubbuck Elementary School, November 251'', 2003. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, Kent Kearns, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Attorney Thomas J. Holmes was excused. Meeting called to order at 7:30 p.m. by Mayor Cotant. PLEDGE ALLEGIANCE TO THE FLAG DAY OF THANKSGIVING PROCLAMATION - Mayor Cotant read proclamation in full. Councilman Quick moved to direct Mayor Cotant to proclaim November 27 ', 2003 to be a "Day of Thanksgiving ", Councilman England seconded. All council members voted in favor of motion. PUBLIC HEARING - An application by Con and Tan' Jensen, 4604 Burley Drive, Chubbuck, Idaho 83202 for a change of Land Use District to Industrial, (I) for property at 4563 Burley Drive. Property is presently zoned, Limited Residential, (R -2). City received a letter from Bureau of Indian Affairs, Fort Hall, Idaho stating the U.S. Government acting through the Fort Hall Irrigations Project of the Bureau of Indian Affairs has an open irrigation lateral, (Little Stuart Lateral) running southerly along the west side of the property. The width of the right -of -way claimed by the United States is 60 feet. The right -of -way must remain clear of obstructions, (including crossing) to facilitate Project operation and maintenance functions. The right -of -way cannot be encroached upon without the written consent of the Bureau of Indian Affairs. Mayor Cotant declared the public hearing open. Con Jensen, 4604 Burley Drive explained the proposal and stated he did not have a problem with the Bureau of Indian Affairs request. There being no comment from the public, Mayor Cotant declared the public hearing closed. Councilman Gunter moved to accept the Land Use and Development's recommendation to approve the application by Con and Tari Jensen for a change of Land Use District to Industrial, (I) from Limited Residential, (R -2) for property located at 4563 Burley Drive, Councilman Kearns seconded. November 25h, 2003 ORDINANCE - Repealing Section 8.36.020, (R) and enacting a new Section 8.36.020, (R) to adopt by reference the Idaho Department of Environmental Quality's designations for varying levels of particulate matter; repealing Sections 13.18.110, "Discharge Limitations "; and 13.20.040, (D) "Concentration Limitations" relating to waste water discharge limitations; adding new Sections 13.18.110 and 13.20.040, (D) adopting by reference the limitations set forth in the City of Pocatello's revised and compiled ordinances; providing for the severability of the provisions of this ordinance. Councilman Quick read ordinance by title only for the first reading. Council tabled the ordinance until the December 9h,2003 Council Meeting. ORDINANCE #579 - Annexing certain lands to be included within the boundaries and jurisdictional limits of the City of Chubbuck Arave Construction - Valley View Village Mayor Cotant read Ordinance #579 in full for the first and final reading. Councilman Quick moved to dispense with the rule of reading Ordinance #579 on three separate days, Councilman Kearns seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. Councilman England moved to adopt Ordinance #579 as read, Councilman Gunter seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. ORDINANCE #580 - Annexing certain lands to be included within the boundaries and jurisdictional limits of the City of Chubbuck; specifying the zoning classification which shall be applied to said lands newly annexed to the City of Chubbuck. Victorian Village 3rd Addition Mayor Cotant read Ordinance #580 in full for the first and final reading. Park Meadows 4`h, 6`h and 7`h Addition Councilman England read Ordinance #581 in full for the first and final reading. Councilman Quick moved to dispense with the rule of reading Ordinance #581 on three separate days, Councilman Kearns seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular Council Meeting Minutes of November 11`h, 2003. Councilman Kearns moved to approve the Regular Meeting Minutes of November 11`h, 2003 as read, Councilman Quick seconded. All council members voted in favor of motion. GENERAL DISCUSSION - 1. Mayor Cotant stated we are debating constructing a double door entry to City Hall, Mayor Cotant stated the Architect said we will not need the double doors, but Mayor Cotant felt the double doors will pay for themselves. After discussion, the Council was in agreement City Hall entry should be a double door entry. 2. Mayor Cotant stated there is going to be a clock installed on the outside of City Hall. Mayor Cotant felt the clock should chime at least on the hour. The chime is an additional $4,000. After discussion, the Council was in agreement the chime should be added. 3. Mayor Cotant received a request from parents and the School District stating the City should signalize the Chubbuck and Hawthorne Road intersection. 4. Mayor Cotant stated in the Spring, 2004, the City is going to re -stripe East Chubbuck Rd from Hiline Road to Valenty Drive to include five lanes and have a center turn lane. 207 COUNCIL MEETING MINUTES - (cont.) Councilman Gunter moved to approve the computer print -out claims a presented, Councilman Quick seconded. All council members voted in favor of motion.
