AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION
9.08.120, CHUBBUCK MUNICIPAL CODE, REGARDING FALSE INFORMATION GIVEN TO
CITY OFFICERS; ADDING A NEW CHAPTER OF THE CHUBBUCK MUNCIPAL CODE
ESTABLISHING A STRUCTURE OF FEES FOR RESPONSES TO FALSE ALARMS; ADDING
A NEW SECTION OF THE CHUBBUCK MUNICIPAL CODE PROHIBITING AUTOMATIC
DIALING ALARM DEVICES; PROVIDING FOR SEVERABILITY; REPEALING PRIOR
CONFLICTING ORDINANCES; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK,
IDAHO:
SECTION 1. False Information. Section 9.08.120, Chubbuck
Municipal Code, is hereby amended to read as follows:
9.08.120 Concealing or false reporting of information to an
officer. It is unlawful and punishable as a misdemeanor for any person
knowingly and intentionally to conceal or withhold knowledge of the
commission of or attempt to commit any felony or misdemeanor in the
city. It is further unlawful and punishable as a misdemeanor for any
person willfully and intentionally to give, or cause to be given, false
information to any police officer or other officer in the city in the
discharge of his duty.
SECTION 2. False alarm fees. Title 5 of the Chubbuck Municipal
Code is hereby amended by adding a new chapter 5.03, the sections of
which shall read as follows:
5.03.01. Definitions. For the purpose of this chaDter:
(a) The term "false alarm" shall mean the activation of a fire
or burglary alarm other than by a fire, forced entry or attempted
forced entry to the premises, at a time when there is no fire and no
burglary or other crime being committed or attempted on the Dremises.
Provided, however, that when the city has been notified that work is
being done on an alarm system, and that the city should not respond to
alarms on that system, such activation of the system shall not be
considered a false alarm.
(b) The term "central system" shall mean a system, or group of
systems, operated for its customers by a person, firm or corporation,
in which the operations of electrical protection circuits and devices
are transmitted, recorded in, and supervised from, a central location.
5.03.02. Scope. This chapter shall apply to any alarm system
that generates an audible sound on the premises, to any alarm system
connected to or monitored by the city, and to any alarm Connected to a
central system.
5.03.03. Fees. For any response by the city to a false alarm,
the city shall charge and collect, from the person, firm or corporation
owning, possessing, operating or maintaining an alarm system on the
p~emises where~the ~atarm was-activate~,~ Gee of~ twenty-five d~tars ~
($25.00) per false alarm. Provided, however, that such fee shall not
apply to the first three (3) false alarms during any calendar year.
SECTION 3. Automatic dialing alarm devices. Title 9 of the
Chubbuck Municipal Code is hereby amended by adding a new section
9.08.125, to read as follows:
9.08.125. Automatic dialing alarm devices. It shall be unlawful
and punishable as a misdemeanor for any person, firm or corporation to
program an automatic dialing device from a fire or burglary alarm to
select any public telephone line used for police or fire calls to the
city. It shall further be unlawful and punishable as a misdemeanor for
an alarm user to fail to disconnect or reprogram such device within
twelve (12) hours of receipt of written notice from the city that an
automatic dialing device is so programmed.

SECTION 4. Severability. In the event that any section or
provision of this ordinance should be held invalid by any court of
competent jurisdiction, such holdinq shall not affect the validity of
the remaining sections or provisions.
SECTION 5. Repeal. Ail prior ordinances of the city, which
irreconcilably conflict with this ordinance, are hereby repealed to
extent of such conflict.

SECTION 6. Effective date. The rule requirinq ordinances
read on three separate days is hereby dispensed with, and this
ordinance shall become effective upon its passage, apDroval and
publication, as provided by law.
