HomeMy WebLinkAbout0234 Fireworks 1982 ORDINANCE NO. 234 CITY OF CHUBB~CK, IDAHO AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 6(4) OF ORDINANCE NO. 180 OF THE CITY OF CHUBBUCK, IDAHO, TOPROVIDE THAT ALL TEMPORARY FIREWORK STANDS SHALL BE PROVIDED WITH ABC DRY CHEMICAL TYPE FIRE EXTINGUISHERS AND FURTHER AMENDING ORDINANCE NO. 180 BY THE INSERTION OF A NEW SUB'SECTION 6(12) REQUIRING THAT ALL TEMPORARY FIREWORKS STANDs BE PROVIDED WITH FIFTY-FIVE (55) GALLON BARRELS WHICH SHALL BE KEPT FULL OF WATER AT ALL TIMES; REPEALING ALL PRIOR ORDINANCES IN CONFLICT WITH THIS ORDINANCE TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: City SECTION 1: Section 6(4) of Ordinance No. 180 of the of Chubbuck, Idaho, is hereby amended to read as follows: SECTION 6: Temporary Fireworks Stands. Ail permitted activities shall be conducted from within a temporary fireworks stand, and the conduct of such activities from any other building, structure, or site is prohibited. Temporary fireworks stands shall be subject to the following regulations: (4) Each stand shall be provided with two (2) two and one-half (2½) pound ABC Dry Chemical type fire extinguishers, in good working order, and easily accessible for use in case of fire. SECTION 2: Section 6 of Ordinance No. 180 of the City of Chubbuck, Idaho, is hereby amended by the insertion of new Sub-section 6(12) to read as follows: (12) Each stand shall be provided with one (1) two (2) gallon bucket and one (1) fifty-five (55) gallon open top barrel with removable lid. The fifty-five (55) gallon barrel shall be kept full of water and covered at all times. This requirement may only be waived by written order of the Fire Chief of the City of Chubbuck. SECTION 3: Ail prior ordinances and parts thereof, which contain provisions in conflict with the provisions of this ordinance, are hereby repealed to the extent of such conflict. SECTION 4: If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction such holding shall not affect the validity or enforceability, of any of the remaining provisions. City Clerk CITY OF CHUBBUCK NOTICE OF ENACTMENT OF ORDINANCE NOTICE IS HEREBY GIVEN THAT: 1) Ordinance #234 of the City of Chubbuck, Idaho, was passed by the City Council and approved by the Mayor on the 27th day of April, 1982. 2) The ordinance is described as an amendment to the Chubbuck Fireworks Ordinance. 3) The principal provisions of the ordinance are summarized as follows: AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 6(4) OF ORDINANCE NO. 180 OF THE CITY OF CHUBBUCK, IDAHO, TO PROVIDE THAT ALL TEMPORARY FIREWORK STANDS SHALL BE PROVIDED WITH ABC DRY CHEMICAL TYPE FIRE EXTINGUISHERS AND FURTHER AMENDING ORDINANCE NO. 180 BY INSERTION OF A NEW SUB-SECTION 6(12) REQUIRING THAT ALL TEMPORARY FIREWORKS STANDS BE PROVIDED WITH FIFTY-FIVE (55) GALLON BARRELS WHICH SHALL BE KEPT FULL OF WATER AT ALL TIMES; REPEALING ALL PRIOR ORDINANCES IN CONFLICT WITH THIS ORDINANCE TO THE EXTENT OF SUCH CONFLICT; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. 4) This ordinance amends the Chubbuck Fireworks Ordinance to require that each temporary fire stand be provided with an ABC dry chemical type fire extinguisher rather than a "soda and acid" fire extinguisher. The ordinance further requires that, unless waived by the Fire Chief, each fire stand shall be provided with a 55-gallon barrel of water and a 2-gallon bucket. 5) This ordinance is effective upon publication of this notice.
