0236 Utility Rates 1982CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 236 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, DECLARING THAT THE CITY COUNCIL HAS REVIEWED THE RATES CHARGED FOR MUNICIPAL SERVICES IN RELATION TO THE COSTS OF PROVIDING SUCH SERVICES; AMENDING CHUBBUCK CITY ORDINANCE NO. 129 TO PROVIDE NEW RATES FOR WATER SERVICE WITHIN AND OUTSIDE THE CITY; FURTHER AMENDING SAID ORDINANCE NO. 129 TO PROVIDE NEW RATES FOR GARBAGE COLLECTION SERVICES WITHIN AND OUTSIDE THE CITY; FURTHER AMENDING SAID ORDINANCE NO. 129 TO PROVIDE NEW RATES FOR SEWER SERVICES WITHIN AND OUTSIDE THE CITY; PROVIDING FOR SPECIAL RATE ADJUSTMENTS; REPEALING ORDINANCE NO. 197 AND ALL PRIOR ORDINANCES TO THE EXTENT OF CONFLICT; PROTECTING THE REMAINING PROVISIONS OF THIS ORDINANCE IF ANY PROVISION SHOULD BE HELD INVALID; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION l: Declaration. The Chubbuck City Council has reviewed in detail the rates charged for municipal services under Chubbuck City Ordinance No. 129, enacted on December 11, 1973, as well as ordinances incorporated by reference therein. The City Council has found that the costs of providing such services have changed, due to general inflationary pressures and growth in the numbers of subscribers to such services. In some instances, such growth has enabled the City to realize economies of scale which tend to alleviate rate increases that would otherwise be required. Having compared the rates and current costs, the City Council has concluded that the new rate schedules, set forth below, should be adopted without delay. SECTION 2: Water Rates. Section 1 of said Ordinance No. 129 is hereby repealed and the following section is substituted therefore: "SECTION l: Water rates. The rates charged for water furnished through the water system shall be as set forth in Ordinance No. 78 of the City of Chubbuck, Idaho, and enacted on June ll, 1968 except that rates for metered water within and outside the City shall be as follows: "A. Within the City, minimum monthly charges, and the water usage allowed for each minimum monthly charge, shall be as set forth in the following table. "B. Outside the City, the rates shall be one hundred fifty percent (150%) of the applicable rates for service within the City." SECTION 3: Garbage Collection Rates. Section 2 of said Ordinance No. 129 is hereby repealed in its entirety and the following section substituted therefor; "SECTION 2: Garbage Collection Rates. The rates charged for garbage collection through the Sanitary Service System shall be as follows: "A. For service to residences within the City, a monthly charge of five dollars ($5.00) shall be imposed for each single-household dwelling and for the first dwelling unit in a multiple-household dwelling complex. A monthly charge of three dollars and fifty cents ($3.50) shall be imposed for the second and each additional unit in such multiple-household dwelling complex. "B. For service to commercial and industrial establishments within the City, a monthly charge equivalent to the single-household dwelling residential charge shall be imposed except that for those establishments required by ordinance to use dumpsters, the monthly charqe shall be thirty three dollars ($33.00) for service consisting of one (1) pickup per week, plus twenty eight dollars ($28.00) per month for each scheduled additional weekly pickup or six dollarsl fifty cents ($6.50) for each additional unscheduled pickup. "C. The rates imposed for sanitary service outside the City shall be one hundred fifty percent (150%) of the applicable rates for service within the City." SECTION 4: Sewer Rates. Sections 3(C) and 3(D) of said Ordinance No. 129 are hereby repealed in their entirety and the following sections substituted therefor: "SECTION 3: Sewer Rates. "C. Monthly Service Charges within City. The monthly charges for sewer service within the City shall be as follows. Single Household Dwelling $8.00 Multiple Household Dwelling Complex 6.50 per unit - Units without cooking facilities 2.00 per unit Churches 8.00 Schools, Commercial or industrial establishments and all other uses 8.00 plus $.35 per thousand gallons in excess of ten thousand gallons of water per month used, or the actual cost attributable to waste water treatment as determined by the approving authority defined in Ordinance No. 128 of the City of Chubbuck, if the latter amount is qreater. "D. Monthly charges outside the City. The monthly charges for sewer service outside the City shall be one hundred fifty percent (150%) of the charges for sewer service within the City." SECTION 5: Special Rate Adjustment. As to all rates for services set forth above, senior citizens and other qualified claimants may file requests for reduced rates. Such applicants must demonstrate that they have qualified during the last calendar year for a tax reduction under Idaho Code Section 63-117 et. seq. Persons who qualify under this section shall be eligible to receive a thirty percent (30%) reduction of the above rates. SECTION 6: Repeal. The conflictin~ provisions Of any prior ordinance are hereby repealed to the extent of such conflict. SECTION 7: Severability. If any provisions of this ordinance shall be held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of the remaining provisions. SECTION 8: Effective Date. The rule requiring ordinances to be read on three (3) separate days-is hereby dispensed with, and this ordinance shall become effective upon its passage, approval and publication as provided by law.
