AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO,
AMENDING ORDINANCE NO. 185 OF THE CITY OF
CHUBBUCK BY ADDING A NEW SECTION NO. 2 (R) AND
ADDING A NEW CORRESPONDING SECTION 9.08.180
TO THE CHUBBUCK MUNICIPAL CODE MAKING ABUSE OF
A POLICE OFFICER A MISDEMEANOR; REPEALING CON-
FLICTING ORDINANCES; PROVIDING FOR SEVERABILITY;
AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION I. New Section. Ordinance No. 185 of the City
of Chubbuck, Idaho, enacted on the 15th day of November,
1977, is hereby amended by the addition of a new section
No. 2(R) to follow section 2(Q), as follows:
(R) Abusing an Officer. Every person who
willfully molests, insults, maligns, harasses, or
threatens any police officer, or other officer of
the City of Chubbuck shall be guilty of a misde-
meanor.
SECTION II: New Section. Chapter 9.08 of the Chubbuck
Municipal Code is hereby amended by enacting a new section
9.08.180, to read as follows:
9.08.180 Abusing an Officer. Every person
who willfully molests, insults, maligns, harasses,
or threatens any police officer, or other officer
of the City of Chubbuck, shall be guilty of a
misdemeanor.
SECTION III: Repeal. Ail prior ordinances or provisions
thereof which conflict with this ordinance or the sections of
Ordinance No. 185 or the Chubbuck Municipal Code as herein
amended are hereby repealed to the extent of such conflict.
SECTION IV: Severability. If any section or provision
of this ordinance, or of Ordinance No. 185 or the Chubbuck
Municipal Code as herein amended, is held invalid by any
court of competent jurisdiction, such holdings shall not
affect the validity of the remaining sections or provisions.
SECTION V: Effective Date. The rule requiring ordinances
to be read on three separate days is hereby dispensed with,
and this ordinance shall become effective upon it's passage,
or approval and publication as provided by law.
