0212 Annexation Chubbuck Road/Alturas Park 1980ORDINANCE NO. 212 CITY OF CHUBBUCK, IDAHO AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING CERTAIN LANDS KNOWN AS THE HERITAGE WEST SUBDIVISIONS TO BE INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL LIMITS OF THE CITY OF CHUBBUCK, IDAHO; SPECIFYING THE ZONING CLASSIFICATIONS WHICH SHALL BE APPLIED TO SAID LANDS; DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY WITH FILING REQUIREMENTS CONTAINED IN IDAHO CODE §63-2215; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1: Annexation. The following described lands, located within Bannock County and contiguous to the existing boundaries of the City of Chubbuck, Idaho, are hereby annexed and included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho: A parcel of land being a portion of the E 1/2 of the SW 1/4 of Section 4, T.6S., R. 34E., B.M., Bannock County, Idaho and more particularly described as follows: Beginning at a point marking the Southwest corner of the said SW 1/4 of Section 4: thence South 89~51'04'' East 1,329.95 feet along the Southerly boundary of the said SW i/4 of Section 4, which is also the centerline of Chubbuck Road, to an iron pin, also said point being the REAL POINT OF BEGINNING; thence continuing South 89051'04'' East 803.16 feet along the said Southerly boundary of the SW 1/4 of Section 4 to an iron pin; thence North 0°13'40" West (formerly described as North 0~13'38" West) 2,654.55 feet along the extended Westerly boundary and the Westerly boundary of Alturas Park, a subdivision, as filed for record in the office of the Bannock County Recorder, Pocatello, Idaho, in Book 9 of Plats at page 45, to an iron pin marking the Northwest corner of the said Alturas Park; thence south 89o55'56'' West 811.61 feet along the Northerly boundary of the said SW 1/4 of Section 4 to an iron pin; thence South 0:24'38" East 2,651.55 feet to the point of beginning, comprising 49.17 Acres, more or less. SECTION 2: Zoning. The above-described lands, newly annexed to the City of Chubbuck, Idaho, shall be subject to the zoning classification of Limited Residential (R-l), except Lots 1 and 2 of Block 1, Lots 1, 2, 3, 4, 5, 6, 7 and 8 of Block 2, and Lots 1 and 2 of Block 4, of the proposed Heritage West No. 1 Subdivision, which shall be subject to the zoning classificiations of General Residential (R-2). The City Council finds and declares that such classifications are con- sistent'with the City Comprehensive Plan. SECTION 3:Filiq~2 The Chubbuck City Clerk is hereby directed to comply with the filing requirements contained in Idaho Code §63-2215. SECTION 4: Effective Date. Full, public hearings having been conducted in this matter, the rule requiring ordinances to be read on three separate occasions is hereby dispensed with and this Ordinance shall become effective upon its passage, approval and publication provided by law.
