AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING
ORDINANCE NO. 185 OF THE CITY OF CHUBBUCK BY ADDING
A NEW SECTION NO. 2(Q) ~gIKING INDECENT EXPOSURE A

3 (A)(2)(a) TO MAKE IT UNLAWFUL TO DRAW, WRITE OR DIS-
PLAY INDECENT, PROFAI~E, OFFENSIVE OR OBSCENE WORDS OR

THE PUBLIC OR TO ALLOW SUCH WORDS OR PICTURES TO
APPEAR ON THOROUGHFARES OR PREI~SES OPEN TO THE PUBLIC;
AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE:CITY OF
CHUBBUCK, IDAHO:
SECTION 1: New Section. Ordinance No. 185 of the City
of Chubbuck, Idaho, enacted on the 15th day of November,
1977, is hereby amended by the addition of a new section no.
2(Q) to follow section 2(P), as follows:
(~) Indecent conduct. It shall be unlawful
for any person to appear in a state of nudity
or' in kny ind'ecent or lewd dress or condition
in any public place where he or she can be
observed, or in a~y such place to make any
indecent exposure of his or her person or privata
parts ther.eof, .?r the private pa~s of ano%her,
or to coD.duct hzmself or herself mn a lewd or
lascivious manner.
SECTION 2: Amendment. Ordinance No. 185 of the City of
Chubbuck, Idaho, enacted on the 15th day of November, 1977,
is hereby further amended by the amendment of Section 3~(A)(1)(b)
and Section 3(A)(2)(a) as follows:
SECTION 3: Uses of Property.
A. Enumeration oflGeneral Nuisances. It
shall be unlawful ~nd punishable as a misdemeanor
for any person to create a nuisance by conduct
with respect to property, or to maintain or
permit the existence of a nuisance due to the
condition of property. The following forms of
conduct with respect to property, and conditions
of property, are hereby declared to be public
nuisances:
(1) Conduct with Respect to Property:
(a) . .
(b) ~hg drawing, writing or displaying of
any indecent, profane, er offensive or obscene
words, pictures or caricatures upon property
located on public premises or on premises open
to the public.
(2) Conditions of Property:
(a) Appearance on property, located on
pedestrian and vehicular thoroughfares or premises
open to the public, of indecent, profane, er offensive
or obscene words, pictures or caricatures.
SECTION 3: Effective Date. This Ordinance shall become
effective upon its passage, approval and publication as
provided by law.
PASSED BY THE COUNCIL AND APPROVED BY THE }~YOR of
the City of Chubbuck, Idaho, this 27 th day of May
1980.
