CITY OF CHUBBUCK, IDAHO
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING
CERTAIN LANDS KNOWN AS THE WEST CHUBBUCK ROAD SEGMENT
AND THE YELLOWSTONE AVENUE/SIPHON ROAD INTERSECTION
SEGMENT TO BE INCLUDED WITHIN THE BOUNDARIES AND JURIS-
DICTIONAL LIMITS OF THE CITY OF CHUBBUCK, IDAHO: PRO-
VIDING THAT SAID LANDS NEWLY ANNEXED TO THE CITY OF
CHUBBUCK LIE WITHIN AND CONSTITUTE PUBLIC RIGHTS OF WAY
AND AS SUCH DO NOT REQUIRE ZONING CLASSIFICATION;
DIRECTING THE CHUBBUC~ CItY CLERK TO COMPLY WITH FILING
REQUIREMENTS CONTAINED IN IDAHO CODE §63-2215; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1: Annexation. The followinq described lands,
located within Bannock County and contiguous to the existinq
boundaries of the City of Chubbuck, Idaho, are hereby annexed and
included within the boundaries and jurisdictional limits of the
City of Chubbuck, Idaho:
WEST CHUBBUCK SEGMENT:
Beqinninq at the South 1/4 Corner of Section 4, Town-
ship 6 South, Range 34 East, Boise Meridian. Thence
Westerly 1315.95 feet, more or less to the extended
Westerly boundary of the Heritage West No. 1
Subdivision.
YELLOWSTONE AVENUE/SIPHON ROAD INTERSECTION SEGMENT:
A parcel of land situated in the East 1/2 of Section
34, TownshiD 5 South, RanQe 34 East, Boise Meridian,
Bannock County, Idaho, more particularly described
as follows:
Commencin~ at the South quarter corner of said
Section 34, said South quarter corner beinQ a 1/2
inch iron Din;
Thence North 0"09'15" West, alonq the meridional
centerline of Section 34, 39.93 feet more or less
to the extended Northerly riqht-of-way line of
Siphon Road;
Thence South 89"51'08" East, along the extended
northerly right-of-way line of Siphon Road, 29.23
fee~, more or less, to the extended Easterly riqht-
Of-way line of Yellowstone Ave.;
Thence South 0°01'13" East, alon~ the extended
eaterly riqht-of-way line of Yellowstone Avenue,
39.93 feet, more or less, to the South line of said
Section 34.
Thence North 89"51'08" West alonq the gouth line of
said Section 34, 29.15 feet, more or less, to the
point of beginning.
SECTION 2: Zoning. The above-described lands, newly annexed
to the City of Chubbuck, Idaho, lie within and constitute public
rights of way and as such do not require zoning classification.
SECTION 3: Filing. The Chubbuck City Clerk is hereby
directed to comply with the filing requirements contained in Idaho
Code §63-2215.
SECTION 4: Effective Date. Full, public hearings having
been conducted in this matter, the rule requiring ordinances to be
read on three separate occasions is hereby dispensed with and this
Ordinance shall become effective upon its passage, approval and
publication provided by law.
