Cotant, Council members Steven M. England, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes and City Clerk Ron C. Conlin. Councilman Leroy S. Quick and Public Works Director Steven M. Smart were excused. Meeting was called to order at 7:30 p.m. by Mayor Cotant. INVOCATION was given by Cliff Rhoades, Chubbuck Sixth Ward, The Church of Jesus Christ of Latter -Day Saints. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Special Meeting Minutes of July 8th, 2003, Regular Meeting Minutes of July 8`h, 2003 and Special Meeting Minutes of July 215`, 2003. Councilman Kearns moved to approve the Special Meeting Minutes of July 8th, 2003, Regular Meeting Minutes of July 8th, 2003 and Special Meeting Minutes of July 215`, 2003 as read, Councilman England seconded. All council members present voted in favor of motion. PUBLIC HEARING - An application by Gary Nelson, 4155 Yellowstone Ave, #1162, Chubbuck, Idaho 83202 for a change of Land Use District to General Commercial, (C -2) for property located at 4640 Hawthorne Road. Property is presently zoned, Agricultural, (A). Mayor Cotant declared the public hearing open. Rick and Angie Wigington, 4719 Kimmi Court expressed concern that a strip mall is going on the property at 4640 Hawthorne Road. They were told there will not be a strip mall. Mr. and Mrs. Wigington were told the plans for the property are for light commercial, insurance sales, dental office, etc. Mayor Cotant closed the public hearing. Councilman Kearns moved to accept the Land Use and Development Commission's recommendation to approve the application by Gary Nelson for a change of Land Use District to General Commercial, (C -2) for property located at 4640 Hawthorne, Councilman Gunter seconded. All council members present voted in favor of motion. 117 COUNCIL MEETING MINUTES - (cont.) July 22nd, 2003 PUBLIC HEARING - An application by Heritage Development, P.O. Box 2684, Pocatello, Idaho 83206 for annexation and a change of zoning to Single Family Residential, (R -1). Property is located west of Hampton and south of Pocano. Mayor Cotant declared the public hearing open. Dixie Ashton, 5369 Whitaker Road asked when the park will be constructed. Mayor Cotant stated the park is being construct now. Mayor Cotant declared the public hearing closed. Councilman England moved to accept the Land Use and Development Commission's recommendation to approve the application by Heritage Development for annexation and a zone change to Single Family Residential, (R -1) on property located west of Hampton Street and south of Pocano, Councilman Kearns seconded. All council members present voted in favor of motion. BANNOCK PLANNING ORGANIZATION'S DRAFT DESIGN CLASSIFICATION MAP - Mori Byington, BPO stated BPO Policy Board has approved the public review of the Draft Design Classification Map: however, they requested that each City Council and the County Commission review the Design Classification Map prior to the public review process. The map establishes the typical Right -OF -Way, (ROW) and Cross Sections for all streets that would be included in the Federal Highway Administration Functional Classification Map. The Design Classification Map identifies the required ROW on existing facilities and the approximate location of future collectors and arterials. Council reviewed the map. There will public review. ORDINANCE - Repealing Sections 5.05.120 and 5.05.150, enacting new Sections 5.05.120 accurate records, 5.05.150 transmittal of daily reports required, 5.05.156 release of held property, 5.05.240 responsibility for compliance. Attorney Holmes read ordinance by title for the second reading by title. Council tabled the ordinance until the August 12 `'', 2003 Council Meeting. 119 COUNCIL MEETING MINUTES - (cont.) July 22nd, 2003 CITY HALL BUILDING ADDITION/REMODEL ADDITION - Pete Anderson, Architect was present to present a proposed addition to the City Hall Addition/Remodel. Pete Anderson stated there have been two proposed change orders 1) Asbestos material was found in the building, cost approx. $7,000. 2) Additional Public Works and Police Department Offices, approx 1200' across the east side of the building, cost approx. $90,000. to $110,000. range. The public and Council reviewed the proposed addition. Councilman Kearns moved to approve the change orders as presented, Councilman England seconded. All council members present voted in favor of motion. CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman England moved to approve computer print -out claims as presented, Councilman Gunter seconded. All council members present voted in favor of motion.
