HomeMy WebLinkAbout03 15 2017 CMCITY OF CHUBBUCK COUNCIL MEETING AGENDA MARCH 15, 2017 — 6:00PM CALL TO ORDER: Mayor England PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Ellis INVOCATION: Hunter Bennet from troop 352 of the Boy Scouts of America PUBLIC HEARING: 1. An application by Matt Shiozawa, 5328 Yellowstone Ave., Chubbuck, ID 83202 for a preliminary PUD plan for lot 1, block 2 of Mingo Subdivision for multifamily infill. Located in northwest 1/ section 3, township 6 south, range 34 east of the Boise Meridian in Bannock County. Location is 5202 Lucky Street. Stuart Ward with Dioptra, 4737 Afton place, represented the applicant. The current zoning is R2, the applicant is proposing a PUD using R4 zoning. The plan includes 4 buildings with 4 units each. The apartments are two and three bedroom units. The mixed use of the area is in conformance with the comprehensive plan and parking requirements are met. The applicant is asking for waiver of 100 sq. feet of private space and will add amenities to the picnic area and drainage swell. Rodney Burch addressed the council. Confirmed the staff report to council and stated that the Land Use Commission suggested the waiver not be granted Mayor opened the public hearing. Rick Capell, 330 James, would like the council to uphold the Land Use Commissions recommendation to not grant the waiver. Mr. Capell would like assurances that there will be fencing, that the city will enforce the code for Planned Unit Developments and that the development cannot be sold off piecemeal. Kevin Campbell, lives next door to the project. Mr. Campbell is worried about the safety of the kids in the neighborhood with the increased traffic. He asked the developer to install a speed bump coming out of the driveway. Sharon Adams, lives along the back of the proposed development. She flood irrigates and uses the two head gates on the property. She asked if the developers are going to install new head gates and what the plans are for the irrigation water to minimize the risk of flooding. Niki Taysom, living at Castillo's on Yellowstone, stated that she is opposed to Planned Unit Developments and apartment complexes and asked the council to only approve large lot, single family development. There being no further comment, the Mayor closed the public hearing 2. An application by Matt Shiozawa, 5328 Yellowstone Ave., Chubbuck, ID 83202 for preliminary plat for Lucky Lane Apartments PUD. Lot 1, Block 2 of Mingo Subdivision. Located in the northwest 1/ section 3, township 6 south, range 34 east of the Boise Meridian in Bannock County. Location is 5202 Lucky Street. Stuart Ward with Dioptra on Afton place represented the applicant. This developments water and wastewater will be served off lucky drive. An irrigation system will be built and could be connected to a secondary irrigation. City staff commented that the application does meet City requirements and recommends approval. Mayor opened the public hearing — Niki Taysom, 4963 Yellowstone, is opposed to the PUD. The irrigation system is communal and should be maintained by the separate owners. There being no further comment the Mayor closed the public hearing. 3. An application by Precision Properties, PO Box 4082 Pocatello, ID 83205 for PUD preliminary development plan for proposed Antler Ridge Subdivision for multifamily infill planned unit development, PUD. Located in the southwest quarter of section 2, township 6 south, range 34 east of the Boise Meridian in Bannock County. Location is north of east Chubbuck Road and west of Kays Kove. Mitch Greer from Rocky Mountain Engineering represented the applicant. The concerns that have been brought to the applicant's attention are the proximity to the intersection of Highline and Chubbuck Roads and the density of the project. The project is 2.35 acres, currently zoned R2. The applicant is proposing a Planned Unit Development. The plan is in complete conformance with the comprehensive plan, encourages infill development, and complies with all City code. The applicant is not asking for any waivers. The development comprises of I I buildings with a total of 44 total living units. There will be an onsite management company to care for the project. The buildings are on the perimeter of the project with the parking on the interior. The amenities include a basketball court, picnic area, and a tot lot. This is a well-designed addition to the City of Chubbuck. Mr. Greer again stated that the plan is in conformance will all guidelines in the City's code. City Staff reminded the council that the Land Use Commission recommended denial because of worries about the impact on adjacent property values. However, the project meets all city standards and the city staff recommends approval. Mayor England opened the public hearing. Belinda Thomas, 48323 Poulder Road. Ms. Thomas is worried that the development will bring to much traffic. She believes it will negatively affect the value of her home. Christin Long, 608 Nathan, would like there to be access for the development off Chubbuck Rd. Bonnie Reed, Kays Kove is worried about traffic and property values. Paul Hall is worried about traffic and property values. Wayne Hale, Whitaker Rd. Mr. Hale is worried about the proposed access. This will directly affect his driveway. Elane Hale, Whitaker Rd. Ms. Hale is worried about the proposed access. This will directly affect her driveway. Sharon Long, Kays Kove is worried about the density of the project. Ross Mincion, Whitaker Rd. is worried about the increase in traffic. Brady Smith, Mr. Smith thinks the proposal is right for the area and a great addition to the City. Darris Ellis, Mr. Ellis believes if the developer has met all the City's requirements then the proposal should pass. Niki Taysom, Yellowstone Ave, the City should not change the zoning of this property, it should remain R2. There being no further comment, Mayor England closed the public hearing. Ryan Lewis thanked the audience for their comments. Melanie Evans asked for an explanation on what could be done with the road. Annette Baumeister explained the need for different types of housing that meets the needs of different stages of life. 4. An application and approval of PUD plan located at 5202 Lucky Street by Matt Shiozawa. Councilmember Evans moved to approve the preliminary plat for Antler Ridge Subdivision condition on the final PUD approval. Councilmember Evans seconded. Councilmember Ellis moved to accept the Offer of Dedication for Briscoe Subdivision Stn Addition. Councilmember Evans seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. CLAIMS: Computer Printout claims for March 15, 2017 as presented to Mayor England and Council. Councilmember Evans moved to approve the claims. Councilmember Baumeister seconded.
