Councilmember Baumeister moved to approve the minutes. Councilmember Evans seconded. Roll call vote: Ellis -yes, Lewis -abstain, Baumeister -yes, Evans -yes. PUBLIC HEARING: 1. Consider proposed ordinance amending section 16.12.025, Access Management, to clarify the application of the guidelines. Rodney Burch, Public Works Director, presented the ordinance. This ordinance will apply the access management policy to not only roadways in commercial and multifamily unit areas but to all roadways including residential. Rodney explained why access management is important. It helps traffic flow, improves safety, maintains and increases the travel capacity of our roadways. Mayor declared the public hearing open. Niki Taysom, Castillo's on Yellowstone, opposes the ordinance, does not think this applies to residential areas. This is a step to allow the government to control travel. Michelle Mitchell, 5285 Kimball, this is in response to a lawsuit with a property having access on both Kimball and Whitaker, she believes this is a knee jerk reaction to the loss, she received a letter and felt singled out, the letter was not sent to the entire city. The first ordinance specifically referenced Whitaker Road and suggested the reference to Whitaker road be removed. The reference was removed. She read all 52 pages and did not see the word residential at all. She thinks the guideline is for commercial traffic not residential traffic. Mayor declared the public hearing closed. Lewis — apologized to Ms. Mitchell. The City did not mean to single anyone out. So much of Chubbuck residential ties into commercial areas. Lewis sees the safety of this as paramount. Going forward, as subdivisions are defined we might not see many applications of the ordinance. 2. An application by Briscoe Bybee Contractors for a Preliminary Plat for the Grove Subdivision 2nd Addition. Stuart Ward, Dioptra, representing the applicant, Mr. Ward described the plat. 10 acres subdivided into 29 single family residential lots. Irrigation will be part of the subdivision and will connect the dry lines in existence. Water will not be cut off from downstream users. The ditch will be piped in this sub. As the city does not want the open ditch in the city. There is one lot that does not meet the width to depth ratio and the applicant would like a variance. Currently there is no second access to the subdivision. Lewis — the single access will service a total of 49 lots. The lot deviation was approved by land use. The developer is asking to pay cash in lieu of building the park. Mayor declared the public hearing open. Ryan Corum — lives on Sawtooth west of Philbin has a concern with the charter schools traffic, it backs up past Sawtooth Street, how will we all leave our subdivision when the school traffic is backed up? Matt Tayor — 1429 Sawtooth believes there was a second access in the original plan. This access was through Griffin Hollow. Mr. Tayor asked why this couldn't happen. Niki Taysom — opposed, need two access. Apposed to cash in lieu of land. Roger Cameron — Sawtooth. Mr. Cameron would like greater ordinance enforcement during construction to control the weeds and the dust. Ms. Collen - 1401 Sawtooth St. is concerned with one entrance. Sasha Elser 1388 sawtooth. Is concerned with one entrance. Mayor declared the public hearing closed. GENERAL BUSINESS: 1. Adoption of ordinance 762 to amend Access Management. Councilmember Evans asked Mr. Holmes his thoughts on the ordinance. Mr. Holmes would advise to go forward, waive the rule and adopt tonight. Councilmember Baumeister moved to waive the rule that the ordinance be read on three separate occasions one being in full. Councilmember Evans seconded. Roll call vote: Ellis -yes, Lewis -yes, -yes, Evans -yes. Councilmember Lewis moved to adopt ordinance #762. Councilmember Baumeister seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. 2. Approval of the Grove Subdivision 2nd Addition Preliminary Plat. Councilmember Baumeister does recognized the concerns with Conner Academy traffic. The city is trying to work through these concerns. Councilmember Lewis explained how he as managed living on Chubbuck Road close to the Chubbuck Hawthorne intersection as there are similar issues there. Councilmember Evans would like more discussion in hopes of finding some resolution to the problems with Conner Academy. Councilmember Baumeister moved to approve the Grove Subdivision 2nd Addition Preliminary Plat. Councilmember Evans seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. 3. Approval of Destruction of Records. Councilmember Evans moved to approve the destruction of records. Councilmember Baumeister seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. 4. Approval of Brookstone Division 7 Final Plat. Councilmember Lewis moved to approve the Brookstone Division 7 Final Plat subject to the approval of the final engineering drawings. Councilmember Evans seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. 5. Approval of Brookstone Division 8 Final Plat Councilmember Lewis moved to approve Brookstone Division 8 Final Plat subject to the final approval of engineering drawings, a solution between staff and the developer on a hammerhead at the end of the road and the addition of irrigation construction details to the plat. Councilmember Evans seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. 6. Approval of Patriot Square Final Plat Councilmember Evans moved to approve Patriot Square Final Plat subject to approval of the final engineering drawings and all lots have sufficient access. Councilmember Lewis seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. 7. Bid review and award for Stuart Park Improvements. Councilmember Evans moved to accept the low bid from Depatco Inc. for Stuart Park Improvements and authorize the Mayor to enter into contract. Councilmember Baumeister seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. 8. Adoption of ordinance 763, Appropriations for FY2017 Councilmember Lewis moved to waive the rule to read the ordinance three times, one reading being in full. Councilmember Evans seconded. Roll call vote: Ellis -yes, Lewis - yes, Baumeister -yes, Evans -yes. Councilmember Lewis moved to adopt ordinance 763. Councilmember Baumeister seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. CLAIMS: Computer Printout claims for August 17, 2016 as presented to Mayor England and Council. Councilmember Baumeister moved to approve the claims. Councilmember Evans seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes. EXECUTIVE SESSION: Pursuant to Idaho Code 74-206(1)(f) to discuss potential litigation. Councilmember Evans moved to go into executive session. Councilmember Lewis seconded.
