COUNCIL MEETING MINUTES

CALL TO ORDER: Mayor England
PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Evans

COUNCIL MEMBERS PRESENT: Josh Ellis, Annette Baumeister, Melanie Evans, and Ryan Lewis
STAFF MEMBERS PRESENT: Hr. Director Scott Gummersall, Captain Bill Guiberson, City Clerk
Rich Morgan, Mayor Kevin England, City Attorney Tom Holmes, Public Works Director
Rodney Burch, and Deputy Clerk Joey Bowers.
Councilmember Ryan Lewis started the meeting on the Phone, and arrived in person later.
APPROVAL OF MINUTES: November 15, 2017
Councilmember Baumeister motioned for approval of minutes with correction.
Councilmember Evans seconded motion for approval of minutes with correction.
Roll Call: Ellis -yes, Evans -yes, Baumeister -yes, Lewis -yes, motion passed.
GENERAL BUSINESS:
1. Regional Economic Development Eastern Idaho Progress Report Presentation.
CEO Jan Roger and local representative Molly Swallow represented the Regional
Economic Development Eastern Idaho, and presented a progress report to the Council.
2. Discussion and possible adoption of updated City Personnel Policy.
Councilmember Ellis motioned for approval of updated personnel policy.
Councilmember Evans seconded motion for approval.
Roll Call: Evans -yes, Baumeister -yes, Lewis -yes, Ellis -yes, motion passed.
3. Ordinance 770 to Amend Snow and Ice Control Policies and Procedure Manual.
Councilmember Baumeister motioned for approval of Ordinance 770.
Councilmember Evans seconded motion for approval.
Roll Call: Baumeister -yes, Lewis -yes, Ellis -yes, Evans -yes, motion passed.
4. Resolution 2017-03 to Adopt Snow Removal Policy.
Councilmember Baumeister motioned for approval of Resolution 2017-03.
Councilmember Evans seconded motion for approval.
Roll Call: Lewis -yes, Ellis -yes, Evans -yes, Baumeister -yes, motion passed.
5. Adopt Ordinance 771 for Change of Land Use Districts for (Antler Ridge Apartments,
Jensen's Cove Subdivision, and Lucky Lane Apartments).
Councilmember Evans motioned for approval of Ordinance 771.
Councilmember Baumeister seconded motion for approval.
Roll Call: Ellis -yes, Evans -yes, Baumeister -yes, Lewis -yes, motion passed.
6. Acceptance of Bids for Siphon Road-Hiline Canal Bridge Construction.
Public Works Director Rodney Burch presented the bid results. Mr. Burch stated that
the bids came in under the estimated cost, and asked Council to approve the winning bid
to Knife River at $455,327. Mr. Burch stated that ITD did not approve the increase of
cost of the Northgate interchange from $8.4 million to $12.5 million in there November
meeting, and are asking the local entities to help make up that difference. The City has
meet with the Bannock Transportation Planning Board and they have decided to delay the
Hawthorne/Quinn intersection and move the budgeted money for that project in the
amount of $2.4 million for the interchange. In addition district 5 has agreed to use State
money and delay improvements at the Alameda/Yellowstone intersection. Both of these
bodies voted unanimously to move these dollars to the Northgate project. Mr. Burch
stated that if Council delays acceptance of the bid that the City will not be able to finish
the utility bridge before the water is back in the canal in 2018.
Councilmember Evans wanted to know if ITD had come to an agreement on the
interchange. Councilmember Evans is concerned about approving this bid until ITD
makes a decision.
Councilmember Ellis stated that this project is absolutely important for the City of
Chubbuck to grow and thrive. Councilmember Ellis felt like this is not the only time that
the State will be coming before the Council requesting additional funds as this project
moves forward.
Councilmember Lewis wanted to know the time frame to accept this bid.
Councilmember Lewis wanted to know if the council could do a conditional award of this
contract based on ITDs decision on the interchange. Councilmember Lewis was
concerned about moving forward until ITD makes a decision. Councilmember Lewis
stated that the City of Chubbuck and the other entities involved shouldn't be responsible
for any more or less than their fair share.
City Attorney Tom Holmes stated that is a conversation that needs to be had between
Rodney and the winning contractor. Mr. Holmes stated that a conditional notice could
violate the bid documents. He felt like Council just needed to approve the winning low
bid, and allow staff to work with the contractor on the issues and concerns that have been
presented.
Councilmember Baumeister was frustrated with the whole process and was concerned
about building a bridge to nowhere. Councilmember Baumeister felt like that the Council
and Staff needs to look at all options before taking this risk.
Mayor could see the Councils concerns, but felt like ITD is dealing with a new project
and ITD doesn't want to commit to more than they should for future requests. Mayor
England was concerned that a negative tone from the Council could cause a no vote from
ITD. Mayor England stated that the Council needs to move forward.
Councilmember Ellis motioned to award the bid of $455,327 to Knife River and allow the Mayor
and Staff to work with the contractor to sign the contract the day after or the day of the ITD
meeting on December 14° 2017. With ITD's approval to move forward with the interchange.
Councilmember Lewis seconded motion for approval.

7. Acceptance of 2017 Election Results.
Councilmember Ellis motioned for approval of 2017 Election Results.
Councilmember Baumeister seconded motion for approval.
Roll Call: Ellis -yes, Evans -yes, Baumeister -yes, Lewis -yes, motion passed.
8. Discussion on Holding December 20, 2017 Meeting.
Councilmember Ellis motioned to cancel the December 20, 2017 meeting.
Councilmember Lewis seconded motion for approval.
Roll Call: Evans -yes, Baumeister -yes, Lewis -yes, Ellis -yes, motion passed.

2. Chubbuck Development Authority claims for December 6, 2017 as presented to
Mayor England and Council.
Councilmember Lewis motioned for approval of Chubbuck Development Claims.
Councilmember Baumeister seconded motion for approval.
Roll Call: Ellis -yes, Evans -yes, Baumeister -yes, Lewis -yes, motion passed.
