HomeMy WebLinkAbout12 18 2017 CMCITY OF CHUBBUCK SPECIAL COUNCIL MEETING MINUTES DECEMBER 18, 2017—11:00AM CALL TO ORDER: Mayor England COUNCIL MEMBERS PRESENT: Josh Ellis, Annette Baumeister, Ryan Lewis, and Melanie Evans. STAFF MEMBERS PRESENT: Captain Bill Guiberson, City Clerk Rich Morgan, Mayor Kevin England, City Attorney Tom Holmes, Public Works Director Rodney Burch, Planning and Development Director Devin Hillam, Engineer Bridger Morrison, Deputy Clerk Joey Bowers. GENERAL BUSINESS: 1. Motion to enter into an Executive Session in accordance with Idaho Code 74-206 (1)(a) "to consider hiring a public officer, employee, staff member or individual agent, wherein the respective qualities of individuals are to be evaluated in order to fill a particular vacancy or need. " Councilmember Ellis motioned to enter into an executive session. Councilmember Lewis seconded motion to enter into executive session. Roll Call: Ellis -yes, Evans -yes, Lewis -yes, Baumeister -yes, motion passed. Councilmember Lewis motioned to exit the executive session. Councilmember Evans seconded motion to exit executive session. Roll Call: Ellis -yes, Evans -yes, Lewis -yes, Baumeister -yes, motion passed. 2. Confirm Appointment of Police Chief. Councilmember Ellis motioned that having thoroughly veted and come to the conclusion that Captain Bill Guiberson will be appointed to Police Chief for the City of Chubbuck. Councilmember Evans seconded motion for approval. Roll Call: Evans -yes, Baumeister -yes, Lewis -yes, Ellis -yes, motion passed. 3. Hiline Canal Utility Crossing — Contract Award. Public Works Director Rodney Burch presented to Council that Staff followed the advice of the Council at the last meeting and have worked with the contractor on awarding this contract after the ITD's decision on the interchange. Mr. Burch stated to meet the March 15, 2018 deadline of completion for the Utility Crossing the City must award this contract to the contractor by Thursday December 21, 2017. Mr. Burch stated that since it is a utility crossing the project meets the original environmental study. Also core engineers have already cleared the wet lands, and thCity has permission from id table their decision on Fort Hall to move forward. Mr. Burch told Council that ITD d funding the increase of additional funds, due to the fact that their engineer was out of town. They did approve an additional $450,000 in engineering/design of the project, for a total investment of $1.06 million on consultants and engineering to move this project forward. Mr. Burch gave a break out of the committed investment for all the involved entities. He stated that ITD has committed to $5 million and local entities (City of Pocatello, Pocatello Development Authority, and Bannock County) cash equals the additional $3.4 million for a total commitment of $8.4 million for the Northgate Interchange. The Developer has committed ($3.4 Million) on road way and utility infrastructure on the east side, and the City of Chubbuck has committed ($5 million) to road way and utility infrastructure on the west side of I15. Mr. Burch stated that the local entities are going to try and get ITD to pay the remaining $4 million for this interchange. Mr. Burch felt like the Council's proposed contingent motion was a solution to mitigate the risk of moving forward with this utility crossing. Mayor England stated that to meet environmental studies and federal law this portion of the project will be a utility crossing and not a bridge. Mayor England felt like ITD's decision to table their decision on the interchange is a positive thing for the local entities. Mayor England felt like the City needed to make a decision to move forward or not. Councilmember Ellis wanted to know what happens if this crossing doesn't meet environmental code. Councilmember Ellis felt like if the Council moved forward on this utility crossing and the interchange for some reason failed, then the City could recoup their investment as development takes place and advantage of this City investment. Councilmember Ellis stated that the City has put additional fees on development for investment repayment in other areas of the City. Councilmember Ellis wanted it known that it is the Council that votes to allow the Mayor to enter into a contract and to spend City money, and that the Council should not be made to feel like they cannot ask questions or be told what to do by those that do not have their name attached to that decision. Councilmember Lewis thought that ITD had already approved and committed to this project with the contract that had already been signed. Councilmember Lewis asked City Attorney Tom Holmes if the Council would be able to require future development to help the City recoup this investment in the future if needed. Councilmember Lewis was concerned about the unknown but wanted the City of Chubbuck and all the involved entities to pay their fair share. Councilmember Lewis wanted the Council to always make principled decisions and not emotional decisions. Councilmember Evans stated that ITD had committed to the $8.4 Million dollar project but not to the increased cost of $12.4 million. Councilmember Evans asked for a break out of the committed investment for all the entities involved. Councilmember Evans was concerned at what cost was going to be placed on the City to make sure this project moves forward. City Attorney Tom Holmes stated he didn't see a problem with that decision. But felt like that should be a decision made in the future if needed. Mr. Holmes felt like the Council needed to award the bid or not award the id a at this waspoithe only decision that was before them. Mr. Holmes had to leave Councilmember Baumeister felt like all the information and options needed to be looked at and discussed before the Council takes a risk and makes a decision. Councilmember Ellis motioned for the Mayor to enter into a contract with Knife River to award the Hiline canal utility crossing contract for $455,327. With a clause to include that should the Northgate Interchange and the Siphon Road extension not be completed; the City will be made whole by all future development on the east bench between Hiline Road and I15, to be determined by the Council at that time. Councilmember Evans seconded motion for approval with the included clause.
