Smart Subject: Dell Road Cul -de -Sac - Property Exchange Date: March 28, 2007 Ron, in order to help you and I out, I decided I should outline the steps from the state code relating to this exchange as authorized by Resolution No. 3-2007. The Notice of Public Hearing should be published one time only, on April 10, for the April 24 City Council Meeting. The item, of course, should be put on the April 24 council meeting agenda. We should also have another item on the agenda that would cover the exchange of property as a result of the public hearing. The item for exchange of property might read something like this: The City Council would consider exchange of property parcels with the owners of 649 and 650 Dell Road. Below, I have prepared the summary of the Declaration of Intent that could be included in the public hearing notice. I will rely on you to format as you usually would. Notice is hereby given that the City Council of the City of Chubbuck will conduct a public hearing with regard to a Declaration of Intent to exchange real property. Such Declaration of Intent to exchange is described in Resolution No. 3-2007. It is the intent of the city to exchange two parcels approximately 1,530 square feet of land each platted inside the Dell Road cul-de-sac for two parcels approximately 54 square feet of land each lying outside the Dell Road cul-de-sac. These property exchanges would be conducted between the city and the property owners of 649 Dell Road and 650 Dell Road. Please give me a copy of the public hearing notice as soon as you prepare it. I will be sending it out to the two property owners. If there is something else that I have forgotten, please feel free to let me know. Thanks, Ron.
