PUBLIC HEARING:
Application by Ellis Construction Lifestyle Homes, 4470 Wasatch St. Chubbuck
ID83202 for Copperfield Landing Division 4 Preliminary Plat.
Councilmember Josh Ellis explained because of his relationship to the developer he
would be recused.
Brady Smith from Rocky Mountain Engineering represented the applicant and presented
the plat to the council. Brady Smith explained an additional storm water retention spot
on the southwest corner of the intersection on McKay Street. The developer would like
to add this retention pond. In the master plan this spot was designated as park. The
developer believes that as the low spot on in the development this additional retention
pond will be used. City staff does not want the retention pond. The engineering on the
plat conducts the water to the park. City staff pointed out that if this corner is needed
then all corners are needed. City Staff believes this lot could be included in the adjacent
building lots. The developer, Darris Ellis, stated that he does not want the liability of
these lots with their potential to flood. Mr. Ellis was asked if he will landscape the lot to
any of the City's specifications. He agreed to include an asphalt walkway from the street
to the church lot, fencing and other improvements. Land use recommendation was to
accept the lot as storm water retention.
Mayor England opened the public hearing.
Niki Taysom — 4963 Yellowstone, Niki supports the plan as proposed. She stated that the
landscaping should be grass instead of rock. She also suggested to change the grading of
the lot so that flooding wasn't a problem.

2. Application by Stewart Nelson, 2630 N Inkom Rd, Inkom ID 83245 for annexation into
the City of Chubbuck the proposed Bilyeu Estates located in southwest '/ of section 4,
township 6 south, range 34 east, of the Boise meridian in the County of Bannock, north
of Chubbuck Rd and east of Philbin Rd.
Joel Dixon RMES representing the applicant. Bilyue Estates. Councilmember Josh Ellis
asked if the City's development fees have been disclosed to the applicant and they have.
Mayor England opened the public hearing.
Niki Taysom — Opposes the annexation.
Darris Ellis — stated this was a great idea.
Councilmember Lewis, ask if staff finds the application in conformance with City
ordinance. Staff stated that the application meets all City requirements.
Mayor England closed the public hearing.
3. Application by Stewart Nelson, 2630 N Inkom Rd, Inkom ID 83245 for zone change of
the proposed Bilyeu Estates located in southwest 1/ section 4, township 6 south, range 34
east, of the Boise meridian in the County of Bannock, from agricultural (AG) to limited
residential (R2)
Joel Dixon RMES represented the applicant and explained the zoning request. The City's
comprehensive plan currently calls for mixed use in this area. The applicant is asking for
an R2 zoning.
Mayor England opened the public hearing.
Diane Bilyue, Philbin Road read a letter she wrote to the council. She would like to
ensure her access to fort hall water is not effected and would like an 8 foot vinyl fence
surrounding her property.
Niki Taysom is dead set against the zone change. She supports the fence and believes it
should be made of brick.
Mayor England closed the public hearing.
4. Application by Stewart Nelson, 2630 N Inkom Rd, Inkom ID 83245 for the preliminary
plat for Bilyeu Estates division 1 located in the southwest 1/ of section 4 township 6
south, range 34 east, of the Boise Meridian in the County of Bannock, north of Chubbuck
Rd and east of Philbin Rd.
Joel Dixon from RMES represented the applicant and presented the plat. Mr. Dixon
explained the drainage on the plat and how it will evolve as the development progresses.
Mr. Dixon also ask if the developer could finish the improvements of Chubbuck Road
during the development of the second half of the plat rather than the first. Staff was
asked if the plat meets City code. It was explained that it does.
Mayor England opened the public hearing.
Niki Taysom opposes the plat. The access is not sufficient. The cost of the sewer is too
high. She does not believe the improvement of the road is the developer's responsibility.
She does not want this ground to be multi use. It is not multi use, it is farm ground.
After general discussion between the council, Ms. Bilyeu and the developer Niki ask to
speak again. She stated that the fence could be an addendum to the sale.
Darris Ellis likes the plan. He would like clarification of plat development being in two
phases. The developer will need to meet all code deadlines with both phases.
Jerry Hernandez is disappointed she has to split lot lines but is in favor of the
development. She would like to ensure that there is dust mitigation during construction.
She would like to ensure that construction access is from Chubbuck Road not Congress
Street.
Boyd Bird spoke in favor of the project and stated that it looks lovely. He believes the
fence should be uniform.
Mayor England closed the public hearing.
GENERAL BUSINESS:
1. Approval of Copperfield Landing Division 4 Preliminary Plat.
Councilmember Lewis moved to accept and approve Copperfield Landing Division 4
Preliminary Plat with lot 1 block 2 being dedicated to the City as park space retention
pond. The park space will include an asphalt path from the street to the church lot,
fencing and landscaping as required by the City. Councilmember Baumeister seconded.
Roll call vote: Ellis -recused, Lewis -yes, Baumeister -yes, Evans -no.
2. Consider adoption of Ordinance 767 for annexation and zone change of the proposed
Bilyeu Estates.
Councilmember Baumeister expressed that it looked like the developer and the adjacent
land owner could work out the concerns between them without government intrusion.
Councilmember Lewis stated that if the City is interested in making sure Ms Bilyeu has a
uniform fence, now would be the time to do that.
It was discussed that the request for no disruption in irrigation water is already law and
Ms. Bilyeu's right.
Councilmember Baumeister moved to waive the rule of reading an ordinance on 3
separate occasions, one reading being in full. Councilmember Ellis seconded. Roll call
vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes.
Councilmember Baumeister moved to adopt Ordinance 767. Councilmember Ellis
seconded. Roll call vote: Ellis -yes, Lewis -no, Baumeister -yes, Evans -yes.
Application for preliminary plat for Bilyeu Estates Division 1.
Councilmember Ellis moved to accept the preliminary plat for Bilyeu Estates Division 1
including the development of Chubbuck Road and a white vinyl fence along the road.
Councilmember Evans seconded. Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes,
Evans -yes
CLAIMS: Computer Printout claims for February 15, 2017 as presented to Mayor England and
Council.
Councilmember Evans moved to approve the claims. Councilmember Baumeister seconded.
Roll call vote: Ellis -yes, Lewis -yes, Baumeister -yes, Evans -yes.
Mayor England adjourned the meeting.
