municipal corpora-

Idaho, creating a
new chapter 18.13 of
the Chubbuck Munic-
ipal Code, pertaining
to personal wireless
telecommunications
facilities, and includ-
ing a purpose state-
ment, definitions,
compliance with
chapter and non-
conforming uses, ex-
emptions, a policy
statement, site selec-
tion criteria, priority
of locations, use pri-
ority on public prop-
erty and siting re-
quirements, co -loca-
tion and design crite-
ria, permit inspection
requirements and
landscaping require-
ments, non-use and
abandonment provi-
sions, third party re-
view, and remedies,
providing that towers
in excess of sixty
feet are permitted in
industrial zones, pro-
viding towers greater
than sixty feet are
subject to conditional
use permit require-
ments in other
zones; providing for
maximum heights
and providing for re-
scission of the mora-
torium on certain
wireless telecommu-
nications facilities;
Providing for the re-
peal of conflicting or-
dinances; providing
for the severability of
the provisions of this
ordinance; providing
that this ordinance
shall be in full force
and effect after its
passage, approval
and publication as al-
lowed by law.

having a general circulation therein.
That the document or notice, a true copy of which is
attached, was published in the said IDAHO STATE JOURNAL,
